Planning & Zoning Commission/ <br />Local Planning Agency <br />October 10, 2012 <br />Page 4 <br />A discussion ensued regarding the existing fences in the neighborhood, the possible locations for the <br />proposed fence and the special needs of Mrs. Fernandez's husband. <br />Mr, Meadows asked for a motion to address BA 12 -06. Mr. Bryan made a motion to approve BA 12 -06 for <br />the property located at 1006 Camelot Way, to allow a 6 foot tall fence 9 feet forward of the front, side building line of <br />a residential property, the motion is based upon the Planning and Zoning Commission's findings of fact and <br />conclusions, the staff report dated September 12, 2012, the property survey included as Exhibit B, and the following <br />conditions: <br />1. The fence shall not exceed six feet and shall not be enlarged in any way. <br />2. The fence shall be maintained in good repair and the good side must face out. <br />3. The fence shall only be allowed 28.5 feet into the front yard adjacent to North Winter Park Drive and <br />will be located no closer to Camelot Way than between the door and the window of the house. <br />4. The fence shall not create a visibility obstruction for traffic. <br />5. Conditional use to sell alcohol in a CG <br />zoning district. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated October 10, <br />2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department), Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). Mr. Sorensen said staff recommends approval with the following conditions: <br />1. The conditional use shall be limited to the location of 1555 State Road 436, Suite 1001, <br />2. All sales and consumption of alcoholic beverages shall be on -site and indoors. <br />3. The sale of alcohol shall not exceed 49% of total revenue. <br />4. Package sales of alcoholic beverages for off -site consumption are prohibited. <br />5. The hours of alcohol sales shall comply with the hours of operation provided in the staff report. <br />
