Planning & Zoning Commission/ <br />Local Planning Agency <br />October 10, 2012 <br />Page 3 <br />Mr. Sorensen said if the Planning and Zoning Commission chooses to approve the variance for BA 12 -06, <br />for the property located at 1006 Camelot Way, to allow a 6 foot tall fence 9 feet forward of the front, side property line <br />of a residential property, the motion should be based upon the Planning and Zoning Commission's findings of fact <br />and conclusions, the staff report dated October 10, 2012, the property survey provided as Exhibit B of the September <br />12, 2012 staff report, and the following conditions: <br />1. The fence shall not exceed six feet and shall not be enlarged in any way. <br />2. The fence shall be maintained in good repair and the good side must face out. <br />3. The fence shall only be allowed 9 feet into the front yard adjacent to North Winter Park Drive and will be <br />located no closer than 14 feet from the front facade (between the window and door). <br />4. The fence shall not create a visibility obstruction for traffic. <br />5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br />A brief discussion ensued regarding the various measurements on the lot provided in Mr. Sorensen's <br />presentation. Mr. Meadows asked the applicant to come forward. Mrs. Hirmina Fernandez, 1006 Camelot Way, <br />Casselberry, Florida came forward. In response to the Commission's question regarding staffs recommendation, <br />Mrs. Fernandez said she feels it is unfair because her neighbor was allowed to build a fence on their property. Mrs. <br />Fernandez said she lived in her home for 35 years. She said she wants a fence due to her husband's health <br />condition. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. Maurice Jenkins, 1030 Camelot Way, Casselberry, Florida came forward. Mr. Jenkins stated he <br />lives adjacent to the property and he has no objection to the fence variance. Mr. Jenkins felt that the City's proposed <br />recommendation was fair. Mr. Jenkins was concerned that if the variance was approved for 18' the fence would be <br />used for graffiti, <br />Mr. Robert Brent, 1035 Camelot Way, Casselberry, Florida came forward. Mr. Brent said he lives across <br />the street from Mrs. Fernandez. Mr. Brent said there is a 4' concrete wall at the entrance to the subdivision. He said <br />there are several homes in the neighborhood that have fences. He said that the children are using people's yards for <br />cut through traffic. Mr. Brent stated that Mrs. Fernandez's husband has dementia and she wants the fence to keep <br />her husband safe. <br />
