Planning & Zoning Commission/ <br />Local Planning Agency <br />August 8, 2012 <br />Page 4 <br />Mr. David Lormbrono, 3438 Allston Lane, Winter Park, Florida came forward. Mr. Lormbrono said he is the <br />president of the Villas of Casselberry Homeowners' Association (HOA). He said any renovation projects are <br />reviewed by the ARC and then are forwarded to the HOA for review. Mr. Lombrono said the HOA Board <br />unanimously approved the proposed fence. He felt denying an individual a fence when other fences have been <br />constructed throughout the community in a similar matter was not appropriate. Mr. Lombrono said that the proposed <br />fence does not go against anything in the HOA documents and the HOA could not find any reason to deny Ms. <br />Graham's application. He said the HOA supports Ms. Graham's variance to allow her to construct her fence. Mr. <br />Lombrono said that the HOA has no objections to the variance and recommend approval for the resident to make this <br />renovation pursuant to the direction from the Planning and Zoning Commission. <br />A brief discussion ensued regarding the ARC and HOA approvals. In response to the Commission's <br />question, Mr. Sorensen said he mailed notices to the surrounding property owners regarding the variance request <br />and he did not receive any feedback. <br />Mr. Meadows asked for final comments from staff and the applicant. There were no final comments. <br />Mr. Guzman said he was a former Board of Adjustment member and the Board struggled with this particular <br />issue because the Code defines a corner lot as having two front yards. He said front yards are only allowed a three <br />foot high fence. He said he was surprised with the City's recommendation to approve the variance based on the <br />request meeting all six criteria required for granting a variance. Mr. Guzman said typically it is not the minimum <br />variance granted because a fence could be constructed from the right corner of the house to the back property line. <br />Mr. Guzman felt that granting the variance would set precedent for other homeowners to request a variance for a <br />fence on a corner lot. A general discussion ensued regarding the side yard being classified as a front yard and <br />several variances that were granted by the Board of Adjustment in the Brittany Gardens subdivision, <br />Mr. Meadows asked for a motion to address BA 12 -04. Mr. Wadley made a motion that the Planning and <br />Zoning Commission grant the variance requested for BA 12 -04 for the property located at 3367 Hamlet Loop to allow <br />a 6 foot tall fence, encroaching 9 feet into a front yard as determined by the location of the main structure, the motion <br />
