Planning & Zoning Commission/ <br />Local Planning Agency <br />August 8, 2012 <br />Page 3 <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated August 8, 2012, <br />to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department), Ms. Regan provided a PowerPoint presentation (a copy is attached and made a part of the minutes). <br />Ms. Regan said the variance application meets all six criteria for granting the variance. <br />She said Staff supports the variance request with the following conditions: <br />1. The fence shall be allowed as indicated in the property survey attached (Exhibit B). <br />2. The fence shall not exceed six feet in height and shall not be enlarged in any way. <br />3. The fence shall be maintained in good repair and the good side must face out or the variance will <br />become null and void. <br />4. The proposed fence shall not come forward of the building fagade along Hamlet Loop. <br />5. The fence shall not encroach into the utility easement. <br />6. The fence shall be erected in line with the Homeowners' Association rules. <br />7. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br />In response to the Commission's question, Ms. Regan said that the homeowner has received approval from <br />the homeowners' association for the construction of the proposed fence. <br />Mr. Meadows asked the applicant to come forward. Ms. Susan Graham, 3367 Hamlet Loop, Winter Park, <br />Florida came forward. Ms. Graham said she agrees with the conditions of approval outlined in the staff report. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Ms. Monalisa Gomez, 1841 Bachman Way, Winter Park, Florida came forward to speak against the <br />variance. Ms. Gomez said that her home backs up to Ms. Graham's home. Ms. Gomez said she has been on the <br />Architecture Review Committee (ARC) for about 17 years and is currently serving as the Chairperson. She said she <br />has lived in her home for the past 19 years and she was told that a fence on a corner lot could not extend beyond the <br />corner of the house. Ms. Gomez said they encourage homeowners to make improvements to their property but <br />within the boundaries of their rules, regulations and their documents. She felt that a nine foot extension to the fence <br />would not be pleasing to the eye and the fence would block her view of the corner of Blaine Terrace and Hamlet <br />Loop. Ms. Gomez said there are other homes in the area that have fences that extend about 3 or 4 feet in the rear of <br />their house. Ms. Gomez said she is objecting to the variance and would appreciate if the Board would consider the <br />aesthetic view of the fence. <br />
