Planning & Zoning Commission/ <br />Local Planning Agency <br />August 8, 2012 <br />Page 2 <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated August 8, <br />2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). Mr. Sorensen said if the Planning and Zoning Commission chooses to recommend approval to the City <br />Commission for SP 12 -01 for the Waffle House preliminary re -plat of 202 State Road 436, Casselberry, Florida, the <br />approval would be based upon the re -plat dated August 2, 2012, the findings of fact and conclusions of the staff <br />report dated August 8, 2012, and the following conditions: <br />1. The applicant shall update the Title Certificate after the sale of the property so the proper owners of the <br />property are indicated. <br />2. All remaining and subsequent City Attorney and City Surveyor comments will be addressed before City <br />Commission approval. <br />3. The City Surveyor shall execute the signature block prior to referral of the final plat to the City <br />Commission. <br />4. The final plat shall be submitted in the following form prior to review by the City Commission: (1) <br />electronic PDF copy and (2) 20" x 24" copies. <br />5. The applicant, per F.S. Chapter 177, is responsible for the City Surveyor and City Attorney fees. The <br />applicant is also responsible for Seminole County recording fees. <br />6. After City Commission approval, the applicant shall provide one (1) mylar of the recorded plat executed <br />by the owner, surveyor and City Surveyor, and any other information requested as part of compliance to <br />F.S. Chapter 177. <br />Mr. Meadows asked the applicant to come forward. Mr. Ryan Peterson, 5986 Financial Drive, Norcross, <br />Georgia came forward. Mr. Peterson said he was available to answer any questions. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for a motion to address SP 12 -01. Mr. Wadley made a motion that the Planning and <br />Zoning Commission recommend approval to the City Commission for SP 12 -01 for the Waffle House preliminary re- <br />plat at 202 State Road 436, Casselberry, Florida, the approval is based upon the re -plat dated August 2, 2012, the <br />findings of fact and conclusions of the staff report dated August 8, 2012, including the six conditions of approval <br />contained in the staff report. Ms. Hoyte -Rene seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: DA 12.04: 3367 Hamlet Loop /Susan Graham. Variance request to Article VII, Section <br />2.7.10, "Fences and Walls," of the Casselberry Unified Land Development Regulations to allow a 6.0 foot <br />high fence to encroach 9 feet into a front yard. <br />
