Planning & Zoning Commission/ Local Planning Agency August 8, 2012 Page 2 Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated August 8, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part of the minutes). Mr. Sorensen said if the Planning and Zoning Commission chooses to recommend approval to the City Commission for SP 12 -01 for the Waffle House preliminary re -plat of 202 State Road 436, Casselberry, Florida, the approval would be based upon the re -plat dated August 2, 2012, the findings of fact and conclusions of the staff report dated August 8, 2012, and the following conditions: 1. The applicant shall update the Title Certificate after the sale of the property so the proper owners of the property are indicated. 2. All remaining and subsequent City Attorney and City Surveyor comments will be addressed before City Commission approval. 3. The City Surveyor shall execute the signature block prior to referral of the final plat to the City Commission. 4. The final plat shall be submitted in the following form prior to review by the City Commission: (1) electronic PDF copy and (2) 20" x 24" copies. 5. The applicant, per F.S. Chapter 177, is responsible for the City Surveyor and City Attorney fees. The applicant is also responsible for Seminole County recording fees. 6. After City Commission approval, the applicant shall provide one (1) mylar of the recorded plat executed by the owner, surveyor and City Surveyor, and any other information requested as part of compliance to F.S. Chapter 177. Mr. Meadows asked the applicant to come forward. Mr. Ryan Peterson, 5986 Financial Drive, Norcross, Georgia came forward. Mr. Peterson said he was available to answer any questions. Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Meadows asked for a motion to address SP 12 -01. Mr. Wadley made a motion that the Planning and Zoning Commission recommend approval to the City Commission for SP 12 -01 for the Waffle House preliminary re- plat at 202 State Road 436, Casselberry, Florida, the approval is based upon the re -plat dated August 2, 2012, the findings of fact and conclusions of the staff report dated August 8, 2012, including the six conditions of approval contained in the staff report. Ms. Hoyte -Rene seconded the motion. The motion passed unanimously by voice vote. Sixth Item of Business: DA 12.04: 3367 Hamlet Loop /Susan Graham. Variance request to Article VII, Section 2.7.10, "Fences and Walls," of the Casselberry Unified Land Development Regulations to allow a 6.0 foot high fence to encroach 9 feet into a front yard.
