Planning & Zoning Commission/ <br />Local Planning Agency <br />June 13, 2012 <br />Page 3 <br />eliminate some of the backyard flooding. Ms. Consalo requested erecting the fence west of the sloped area due to <br />liability concerns with pedestrians using the sidewalk. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for final comments from the City and the applicant. There were no final comments. <br />Mr. Meadows asked for a motion to address BA 12 -02. Mr. Wadley said that the variance application meets <br />all six criteria for granting a variance and the variance was granted across the street. Mr. Wadley moved that the <br />Planning and Zoning Commission grant the variance requested for BA 12 -02, for the property located at 1001 Park <br />Drive, to allow a 6 foot tall fence 31.5 feet forward of the main building line of the property based upon the Planning <br />and Zoning Commission's findings of fact and conclusions, the staff report dated June 13, 2012, the property survey <br />(Exhibit B), and the conditions outlined in staff's presentation. Mr. Weinroth seconded the motion. The motion <br />passed unanimously by voice vote. <br />Sixth Item of Business: CU 12 -04: 252/256 SR 436Neritas Park Academy. Conditional use request to allow an <br />Educational Institution in the CG zoning district. <br />Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated <br />June 13, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part <br />of the minutes). <br />Mr. Sorensen said upon review of the conditional use request, the Planning and Zoning Commission's <br />approval of CU 12 -04 to allow an educational institution use within the CG zoning district at the property located at <br />252/256 State Road 436, should be based on the findings of fact and conclusions of the staff report dated June 13, <br />2012 and the following conditions: <br />1. The conditional use shall be limited to the location of 252/256 State Road 436. Expansion of the <br />educational institution will require a new conditional use approval. <br />2. The number of students shall not exceed thirty -two. A new conditional use must be obtained to increase <br />student size. <br />3. The pedestrian crossing pavement markings shall be re- painted to clearly show the cross - walks. <br />4. There shall be no drop -off or pick -up of students in the drive aisles. All vehicles will park in parking <br />spaces and children will be escorted to and from the tenant space <br />
