Planning & Zoning Commission/ <br />Local Planning Agency <br />June 13, 2012 <br />Page 2 <br />Fifth Item of Business: BA 12 -02: 1001 Park/William Antrim. Variance request to Article VII, Section 2 -7.10 <br />"Fences and Walls" of the Casselberry Unified Land Development Regulations to allow a 6 foot fence to <br />encroach 31.5 feet into a front yard as determined by the principal structure of the lot. <br />Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated <br />June 13, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department), Mr. Sorensen provided a PowerPoint presentation (a copy is attached and made a part <br />of the minutes). <br />Mr. Sorensen stated that the variance application meets all six criteria for granting the variance; therefore, <br />Staff supports the variance request. He said if the Planning and Zoning Commission chooses to grant the variance <br />requested for BA 12 -02, for the property located at 1001 Park Drive, to allow a 6 foot tall fence to encroach 31.5 feet <br />into the required front yard setback, the motion would be based upon the Planning and Zoning Commission's findings <br />of fact and conclusions, the staff report dated June 13, 2012, the property survey (Exhibit B), and the following <br />conditions; <br />1. The fence shall not exceed six feet and shall not be enlarged in any way. <br />2. The fence shall be maintained in good repair and the good side must face out or the variance will <br />become null and void. <br />3. The fence shall only be allowed 31.5 feet in the front yard adjacent to North Winter Park Drive and will <br />not be placed forward of the front fagade facing Park Drive. <br />4. The fence shall not create a visibility obstruction for traffic. <br />5. The chain link fence will be removed when the other fence is erected. <br />6. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br />Mr. Meadows asked the applicant to come forward. Ms. Karen Consalo, attorney, 303 Hardwood Street, <br />Orlando, Florida and Mr. William Antrim, 1001 Park Drive, Casselberry, Florida came forward. Ms. Consalo said that <br />they agree with staffs report and agreed to remove the chain link fence. Ms. Consalo submitted a petition signed by <br />the adjacent neighbors in favor of the variance, photographs of the partially built wooden fence, the intersections of <br />Winter Park Drive /Park Drive and the backyard and Seminole County traffic counts for Winter Park Drive (copies are <br />attached and made a part of the minutes). <br />Ms. Consalo explained that the Winter Park Drive road improvements caused drainage issues causing the <br />backyard to flood. She said the previous owner built a steep grade approximately 4% from the sidewalk to help <br />
