Planning & Zoning Commission/ <br />Local Planning Agency <br />March 14, 2012 <br />Page 4 <br />1371 as contained in item MISC 12 -01 to impose a temporary moratorium for 180 days on the issuance of business <br />tax licenses, permits, development orders or any other official action related to game rooms and similar indoor <br />entertainment and amusement type activities within the City limits. Mr. Bryan seconded the motion. The motion <br />passed unanimously by voice vote. <br />Sixth Item of Business: CU 12.01: Pathways to Care. Conditional use request to amend the Development <br />Order related to the operation of a convalescent care facility. <br />Ms. Sandra Smith, Development Services Manager, reviewed the information provided in her memorandum <br />dated March 14, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Ms. Smith said this is an amendment to a development order that was established in 2002 <br />for the Pathways to Care operation located on Plumosa Avenue. She said it is a convalescent care facility with 40 <br />beds and the development order affiliated with this use was quite extensive. Ms. Smith said Pathways to Care has <br />made several amendments to the development order due to some of the restrictions that were placed in the original <br />development order that were not workable due to State requirements and the operation of the facility. <br />Ms. Smith said Pathways to Care is requesting to change Section "u" of the Development Agreement which <br />currently reads: "The average length of stay shall not exceed six weeks for the forty beds and the applicant shall <br />provide a verified report to the City every six months which details the average length of stay and shall provide the City <br />a copy of its patient admission /discharge log for said reporting period. As used herein, "average length of stay" shall <br />be calculated by adding the number of days each patient has stayed at the facility during the six -month reporting <br />period and dividing that sum by the total number of admissions during said six -month reporting period." Ms. Smith <br />said Pathways to Care is requesting to reduce the time frame limit on 10 beds which would allow the facility to deal <br />with more critical cases that come to their facility. <br />Ms. Smith stated she contacted the City's Police and Fire Department regarding any problems they <br />encountered with the operation of the facility. She said the Police Department had no problems with the facility and <br />the Fire Department said they have responded to several calls to transport patients by ambulance. She said there <br />have been no negative impacts on the surrounding area. Ms. Smith said when Pathways to Care was initially brought <br />
