The motion <br />passed unanimously by voice vote. <br />Fifth Item of Business: MISC 12.01: Internet Cafe Moratorium. Moratorium on Internet cafes and similar <br />uses. <br />Ms. Sandra Smith, Development Services Manager, reviewed the information provided in her memorandum <br />dated March 14, 2012, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the <br />Community Development Department). Ms. Smith said over the last few years the City has requested a moratorium <br />to prohibit the issuance of licenses and permits for any type of business that would be considered an internet cafe, <br />sweepstakes redemption center and other similar type uses. She said the City has previously approved a <br />moratorium on internet cafes which included several extensions. Ms. Smith said Staff was hoping that the State <br />would take action to deal with internet cafes. She said Seminole County passed an ordinance prohibiting the use of <br />simulated gambling devices within the Seminole County area including all the other jurisdictions within the County. <br />She said that has been litigated and an injunction was placed on that which has since been lifted and now that is also <br />being litigated. Ms. Smith said Staff has been hoping to get some kind of resolution on internet cafes and whether <br />they are allowed, prohibited or should be regulated. She said up to this point in time none of that has occurred. Ms. <br />Smith said the last extension expired March 7, 2012 but the City Commission had initiated action prior to that so <br />there is legislation in progress which gives staff the ability to deny any applications, permits or licenses for these <br />types of uses under those criteria. <br />Ms. Smith said in order to expedite this item the City Commission has reviewed this at first reading; <br />however, the City Commission prefers to have a recommendation from the Planning and Zoning Commission to <br />support their initiatives. Ms. Smith requested the Planning and Zoning Commission provide a favorable <br />recommendation to the City Commission to adopt the ordinance related to the moratorium for internet cafes. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Meadows asked for a motion to address MISC 12 -01. Mr. Wadley made a motion that the Planning and <br />Zoning Commission provide a favorable recommendation to the City Commission for the adoption of Ordinance 12- <br />
