Planning & Zoning Commission/ <br />Local Planning Agency <br />May 8, 2013 <br />Page 6 <br />Mr. Lefkowitz said that he will continue to do business in Casselberry until his lease expires in December <br />2013. Mr. Lefkowitz felt that the City's Code is highly discriminatory. He said other businesses in the City are <br />allowed to store items outside and restaurants are allowed outside seating. He said there is something very basically <br />wrong with the way the Commission is approaching cultivating the businesses they want. <br />Sixth Item of Business: LPA 13.02: Solicitor's Permit Ordinance. Amendments to City Code, Chapter 26, <br />Businesses, Article III, Peddlers, Solicitors, Begging and Panhandling. <br />Mr. Jason Sorensen, Planner I, requested that this item be continued until the next meeting as the City <br />Attorney has not completed her review of the ordinance. <br />Mr. Meadows asked for a motion to continue LPA 13 -02, Solicitor's Permit Ordinance. Mr. Wadley made a <br />motion to continue this item. Mr. Guzman seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: LPA 13.04: Impact fee Schedule Ordinance. Amending various Chapters within <br />the City Code to adopt the fees and structure for the recently adopted Impact Fee Study. <br />Ms. Marie Regan, Planner II, requested this item be continued to the next Planning and Zoning Commission <br />meeting due to an error in advertising. Mr. Meadows asked for a motion for LPA 13 -04, Impact Fee Schedule <br />Ordinance. Mr. Bryan made a motion to continue this item. Mr. Wadley seconded the motion. The motion passed <br />unanimously by voice vote. <br />Eighth Item of Business: Other Business. <br />Tree Information <br />Mr. Jason Sorensen, Planner I, and Ms. Marie Regan, Planner, II, reviewed a PowerPoint presentation (a <br />copy is attached and made a part of the minutes). A general discussion ensued regarding the following items: <br />1. Calculations of plant units <br />2. Mathematic problems in determining tree calculations <br />3. Clarification regarding nuisance trees size <br />4. Breakdown of commercial /residential acreage of the City and Planned Communities <br />5. Options for tree replacement for dead trees on commercial sites <br />• if the site meets the landscaping requirements - no replacement would be required <br />• set a specific amount of dbh for a site rather than by the number of trees on the site — if it <br />exceeds that amount — no replacement would be required <br />• if the site does not meet the landscaping requirements - a tree for tree replacement would <br />be required <br />6. Caliper versus dbh sizing <br />7. Residential tree replacement criteria /landscaping requirements <br />8. Duplex — commercial /residential designation for tree replacement <br />
