Planning & Zoning Commission/
Local Planning Agency
May 8, 2013
Page 5
In response to the Commission's question regarding modifying the door on the building to accommodate the
larger bikes and eliminate the trailer for storage, Mr. Lefkowski said he received an estimate regarding modifying the
front door and it was a significant amount.
A general discussion ensued regarding the relocation of the trailer to the rear of the property and the
removal of the bikes at the end of the day.
Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition
to, the request. Mr. James Fraleigh, a resident of Casselberry came forward to speak in favor of the variance. Mr.
Fraleigh said we are supposed to draw businesses to our City not push them away. He said the harassment in the
City needs to stop. He said we need to look at what is good for our community instead of all the regulations.
Ms. Smith said the City works very diligently to ensure that there is no outside display of goods in the City.
Ms. Smith said Ding Bikes has a ground sign and a facade sign on the site. She said the applicant has the ability to
determine how the amount of signage allowed on the site will be distributed.
Ms. Smith stated that staff is concerned with the unsafe testing of the bikes in the parking lot. She said staff
would prefer the testing of bikes be conducted to the side of the building for safety issues.
A general discussion ensued regarding visibility of the site, the criteria necessary to grant the variance,
designating the area to the north of the building as the testing area, the use of the trailer on the site, modification to
the door to accommodate the bikes and City Code Section 3 -10.2 regarding screening outside storage.
A brief discussion ensued regarding that the approval would be based on the Order from the Planning and
Zoning Commission and not the site plan.
Mr. Howard Lefkowitz said that it is clear on the Commission's standpoint on this request. He said they tried
to demonstrate very specifically the need for the outside display. He said that he is not interested in staffs
recommendation. Mr. Lefkowitz respectfully withdrew his request. He said Ding Bikes would make the commitment
to the Commission that there would be no outside display of goods and the bike stored in the trailer would be
disassembled.
