CASSELBERRY CITY COMMISSION <br />Minutes of October 8, 2012 — Regular Meeting <br />Page 9 of 14 <br />evolved over the years since adoption of the original ordinance in 2007. She stated that the proposed Code <br />revision eliminates boats and ATV's from the 24 -hour parking provision, but does not address the parking <br />frequency issue, and the Planning and Zoning Commission and staff were seeking direction from the City <br />Commission on both the type of vehicle and the frequency issues. <br />Discussion: A lengthy discussion ensued regarding the various types of recreational vehicles and whether <br />additional restrictions should be imposed requiring permitting or a limit to the frequency of overnight parking <br />in residential driveways. The Commission agreed by consensus that the revision to the Code should not <br />eliminate boats and ATV's, but that it should include language that would prohibit the 24 -hour parking <br />provision from being consecutive 24 -hour periods. The Commission felt as a whole that the City's Code <br />Enforcement staff would be alert to abuses of the allowed provision, and that the slight changes to the current <br />Code would add strength to the officers' ability to enforce the Code. Ms. Smith advised she would present the <br />City Commission's recommendations to the Planning and Zoning Commission at its upcoming meeting, and <br />thanked the Commissioners for their direction. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The City Manager and the Acting Community Development director recommended City <br />Commission discussion and direction to staff and the Planning and Zoning Commission regarding the proposed <br />amendment to the Unified Land Development Regulations (ULDR). <br />B. Request for Reduction of Code Enforcement Lien — 1555 State Road 436 <br />Staff Presentation: Acting Community Development Director Sandra Smith stated that this item was a <br />request to reduce a Code Enforcement lien from $8,300 down to $4,150, which would be a 50% reduction in <br />the lien. She explained that the violation was for erection of a sign without a permit by a tenant within the <br />shopping center and the matter had gone before the Code Enforcement Board. She added that when the <br />property owners had become aware of the violation, the sign had been immediately removed. She further <br />stated that the property owners had requested a reduction of the lien and that the Code Enforcement Board had <br />reviewed the matter at its last meeting and recommended that the 50% reduction to the fine be approved. The <br />property owners were not present to address the Commission. <br />Budget Impact: The lien amount paid would be recognized as revenue in the 001 - 0000 - 354.20 -00 Violations <br />of Local Ordinance account. <br />Recommendation: The City Manager and Acting Community Development Director recommended <br />consideration of the Code Enforcement Board's recommendation to reduce the lien for Case #CE -12 -00133 <br />from a total of $8,300 to $4,150 to be paid within 60 days. <br />MOTION: Commissioner Miller moved to reduce the Code Enforcement lien on property <br />located at 1555 State Road 436 for Case #CE -12 -00133 from $8,300 to $4150.00. <br />Motion was seconded by Commissioner Aramendia. <br />
