CASSELBERRY CITY COMMISSION <br />Minutes of September 24, 2012 — Regular sleeting <br />Page 9 of 21 <br />MOTION: Cmnnnissionci- Solomon Moved to approve Resolution 12 -2419 establishing the <br />final Operating Budget for the City of Casselberry in the amount of <br />$43,649,389 for Fiscal Year 2012 -2103, as presented. Motion was seconded by <br />Commissioner Aramendia. Motion carried unanimously by voice vote 5 -0. <br />Mayor Glancy announced that the City of Casselberry has adopted a Final Budget for Fiscal Year 2012 -2013. <br />C. Second Reading of Ordinance 12 -1377 — Amend City Code Chapter 58, Article VI, <br />Residential Property Registration (LPA 12 -06) <br />The City Clerk read Ordinance 12 -1377 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY CODE OF ORDINANCES, PART H, CHAPTER 58, OFFENSES, PUBLIC <br />NUISANCES AND MISCELLANEOUS PROVISIONS, ARTICLE IV, RESIDENTIAL PROPERTY <br />FORECLOSURES TO INCLUDE COMMERCIAL REAL PROPERTY REGISTRATION; <br />CLARIFYING PROPERTIES REQUIRED TO BE REGISTERED; PROVIDING MINOR EDITS; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to the second reading of Ordnance 12 -1377 <br />was published in the Orlando Sentinel on September 13, 2012. <br />Staff Presentation: Development Services Manager Sandra Smith gave a brief overview of the item, stating <br />that the purpose of the ordinance was to firm up the language contained in original ordinance passed in 2009 <br />initiating the City's residential property registration. She added that the ordinance being considered also <br />proposed to include commercial properties in the City's registration program as a proactive measure in <br />response to concerns of staff about impacts on the City's commercial properties due to the two flyover projects <br />and current economic trends. She added that the ordinance was passed by the Commission on first reading. <br />Ms. Smith advised that representatives of a commercial realtors' group were in attendance to make a <br />presentation proposing an alternative solution to commercial property registration. <br />Mr. Mike Shelton, Mr. Lou Nimkoff and Ms. Frankie Elliott, representing the Orlando Regional Realtor <br />Association, addressed the Commission and explained that commercial properties were financed differently <br />and handled differently than residential properties. They expressed their belief that itwould be very difficult <br />for the City to police the ordinance as it was being presented, and suggested that as an alternative their <br />association would be willing to partner with the City by assisting with locating property owners or managers <br />for properties the City observed as having problems. <br />In response to questions from Mayor Glancy, Ms. Elliott clarified that their understanding was that the <br />ordinance was a proactive measure, and that there were not a large number of blighted commercial properties <br />in the city. She agreed that it was a good idea to be proactive, but she and her group would suggest trying a <br />cooperative agreement before going forward with an ordinance or more restrictions. <br />Commissioner Solomon stated that she appreciated the three brokers coming to the sleeting, but that the City <br />
