CASSELIIERRY CITY COMMISSION <br />Vlinotes of September 24,2012 — Regular Meeting <br />Page 10 of 21 <br />does take a proactive approach in these matters, and she would be in favor of going ahead with the proposed <br />ordinance as presented to include both residential and commercial. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 12 -1377 on second and final reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 12 -1377. The following <br />individual(s) came forward: <br />1. Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to the ordinance, stating Ire felt it <br />would impose unnecessary regulations. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 12 -1377. <br />Mayor Glancy reminded the Commission that there were two options for the motion on this item: first, to <br />move forward with the original ordinance, as presented, including residential and commercial; and second, to <br />approve the ordinance without the commercial element. <br />In response to questions fi•on Commissioner Aramendia, Ms. Smith explained that the amendments were being <br />brought forward and staff had decided it would also be an opportunity to take a proactive approach and include <br />commercial properties in the registration program. She added that then the legislation would already be in <br />place should problems arise with commercial properties. <br />A brief discussion ensued regarding property with issues that could possibly be addressed by the realtors' <br />group and then brought back to the Commission for review. Commissioner Solomon expressed her view that it <br />would be a good idea to put the commercial property registration in place. <br />MOTION: Vice Mayor Hufford moved to adopt Ordinance 12 -1377 on second and final <br />reading, as presented. Motion was seconded by Commissioner Solomon. <br />Discussion: A lengthy discussion ensued regarding the proactive approach to problems with commercial <br />properties which was being proposed, and the alternatives being suggested by the realtors' group. <br />MOTION: Vice Mayor Huffo•d moved to amend the previous motion by changing the <br />wording to approve the ordinance as amended to eliminate the verbiage <br />contained in the agenda packet pertaining to inclusion of commercial <br />properties. Motion was seconded by Commissioner Miller. Motion carried by <br />voice vote 4 -1, Commissioner Solomon dissenting. <br />Original Motion, as amended, carried by voice vote 4 -1, Commissioner Solomon <br />dissenting. <br />
