CASSELRERRY CITY COMMISSION <br />Minutes of September 24, 2012 — Regular Aleefing <br />Page 11 of 21 <br />D. Second Reading of Ordinance 12 -1378 — Amending City Code Section 82 -13, <br />Abandoned or derelict vehicles <br />The City Clerk read Ordinance 12 -1378 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING TEXT WITHIN <br />THE CITY OF CASSELBERRY CODE OF ORDINANCES, PART II, CHAPTER 82, TRAFFIC AND <br />VEHICLES, ARTICLE 1, SECTION 82 -13, "ABANDONED OR DERELICT VEHICLES ", TO <br />ELIMINATE PARKING OF INOPERABLE VEHICLES IN CARPORTS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative tothe second reading of Ordinance 12-1378 <br />was published in the Orlando Sentinel on September 13, 2012. <br />Staff Presentation: Development Services Manager Sandra Smith gave a brief overview of the item, stating <br />that the proposed ordinance was to provide consistency in terms and storage requirements between the City <br />Code of Ordinances and the City's Unified Land Development Requirements. She stated staff had contacted <br />the Police Department to ensure the proposed amendments were acceptable for enforcement purposes. She <br />added that the Commission had approved the ordinance by a 4 -1 vote on first reading at its August 27, 2012 <br />regular meeting. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption of <br />Ordinance 12 -1378 on second and final reading. <br />Mayor Glancy left the Chambers at approximately 10 :45 p, m. <br />Public Hearing: Vice Mayor Hufford opened the public hearing relative to Ordinance 12 -1378. The <br />following individuals came forward: <br />Mr. John Casselberry, 700 South Lost Lake Lane, voiced opposition to the ordinance, stating <br />his belief that the City should not get involved in regulating vehicles on carports which is <br />considered private property. <br />Mayor Glancy returned to the Chambers at approximately 10:50p. m. <br />2. Mr. James Fraleigh, 23 Teresa Court, voiced opposition to the ordinance, stating his <br />agreement that the City should not regulate what residents have on their own private property <br />and expressing his feeling that the City was implementing too many regulations on its <br />citizens. <br />Vice Mayor Hrtfford left the Chambers at 10:51 p.m. <br />Vice Mayor H:rfford returned to the Chambers at 10:54 p.m. <br />
