CASSELBERRY CITY COMMISSION <br />Minutes of September 10, 2012 — Regular Meeting <br />Page 7 of 14 <br />PROVISIONS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND <br />EFFECTIVE DATE." <br />Staff Presentation: Mr. Newlon reminded the Commission that in the August election the citizens of <br />Casselberry had approved a referendum that modified the Charter requirement for the City Manager to live in <br />the City. He added that earlier in the year the Commission had met and considered what requirements were <br />seen as desirable in recruiting a city manager. He further added that since that time it had been observed that <br />requirements relating to the City Manager existed in both the City Charter and the City Code. He stated that <br />the Charter needed to be modified to incorporate the referendum results and to correct duplications in the City <br />Code which mirrored what was already contained in the Charter. As a result of these observations, Human <br />Resources Manager Andy Brooks and City Clerk Donna Gardner worked together to craft an ordinance to <br />remedy those issues. <br />Mr. Brooks gave an overview of the changes proposed in the ordinance, including corrections to references; <br />deletions of duplicative language; incorporation of the suspension of the residency requirement for the City <br />Manager approved by the referendum; updates to outdated language; and various other references to the <br />powers and duties of the City Manager. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the City Clerk recommended approval of Ordinance 12- 1381on <br />first reading. <br />Audience Input: The following individual came forward to address Ordinance 12 -1381: <br />1. Mr. John Casselberry, 700 South Lost Lake Lane, voiced concerns that the Code did not make any <br />reference to the procedures for the hiring of an interim city manager. He suggested that the <br />Commission may wish to include a requirement for an interim city manager to be a Florida resident, to <br />ensure familiarity with Florida law. <br />No one else came forward to address Ordinance 12 -1381. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 12 -1381 on first <br />reading, as presented. Motion was seconded by Commissioner Miller. Motion <br />carried unanimously by voice vote 5 -0. <br />A.
