CASSELBERRY CITY COMMISSION <br />Minutes of July 23, 2012 — Regular Meeting <br />Page 5 of 11 <br />Voluntary Development Commitment Agreement with the property owner and developer speaking to items <br />such as on- street parking, dedicated parking, retention areas, landscape material, street front walls entry <br />features and proposed facades and floor plans. She added that even if these three items were approved, the <br />owner /developer would still be required to seek site plan and plat approvals from the City. <br />Ms. Smith reminded the Commission that if the requested amendments are approved, the garden home concept <br />will allow 51 lots to be developed on the Tract G site by using reduced side corner yards, reduced side and rear <br />yard setbacks from residential properties located outside the Seminola Boulevard Overlay District. She added <br />that it will reduce the lot width and the lot area and increase the amount of impervious area on the lot while <br />reducing the required open space on the lot. She stated that the requested amendments to the design criteria <br />will increase the living area of the residential units. <br />Ms. Smith advised of a correction to Section 5 of the Ordinance to correct a scrivener's error showing that the <br />amendment is included in "Attachment A ", but it should actually read "Exhibit A ". She briefly explained that <br />"Exhibit A" was a part of the Ordinance to be approved, and Attachments A -F were the attachments to the <br />Planning and Zoning Attachment and were included for information purposes. Ms. Smith clarified further that <br />the original Ordinance adopted in 2002 included "Exhibit C" setting forth the various development types, and <br />this ordinance tonight would incorporate the designs shown in "Exhibit A" to the existing "Exhibit C" of the <br />design criteria for the Seminola Boulevard Overlay District. <br />In response to questions from Commissioner Miller, Mr. Newlon stated that instead of 66 townhomes, this <br />would result in 51 single family residential units which would be of greater value, adding possibly as much as <br />$10 million dollars in total value to the City's housing stock. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />adoption of Ordinance 12 -1376 on second and final reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 12 -1376. The following <br />individual(s) came forward: <br />I. Mr. Ken Wright, of Shutts & Bowen, representing the applicant Pulte Homes, expressed appreciation <br />for the City's suggested recommendations, stating that they had been incorporated into a Voluntary <br />Commitment Agreement which would be coming up later in the meeting. He stated that a lot of effort <br />had gone into designing a family friendly product that would be an asset to the City and would meet <br />the goals and the mission of the City in terms of growth. He encouraged the passing of the Ordinance <br />and the subsequent Resolutions. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 12 -1376. <br />MOTION: Commissioner Solomon moved to approve and adopt Ordinance 12 -1376 on <br />second and final reading, as amended to include Exhibit "A ". Motion was <br />seconded by Commissioner Miller. <br />
