CASSELBERRY CITY COMMISSION <br />Minutes of July 9, 2012 — Regular Meeting <br />Page 10 of 18 <br />Recommendation: The Interim City Manager and the City Attorney recommended approval of Resolution <br />12 -2398. <br />MOTION: Vice Mayor Hufford moved to approve the Consent Agenda, as presented. <br />Motion was seconded by Commissioner Solomon. Motion carried unanimously <br />by voice vote 5 — 0. <br />Commissioner Miller reminded everyone of the Budget Workshop scheduled for tomorrow night, and noted <br />that if all goes as planned, the Commission will be announcing a tax decrease for the fourth year in a row. <br />A. Second Reading of Ordinance 12 -1373 — Amendments to Chapter 14, Article II, <br />Special Events, Open air sales, etc. — Issuance of Special Event Permits and <br />Alcoholic Beverage Licenses <br />The City Clerk read Ordinance 12 -1373 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY CODE OF ORDINANCES, PART II, CHAPTER 14, AMUSEMENTS, ARTICLE II, <br />SPECIAL EVENTS, OPEN AIR SALES, OPEN AIR FOOD SALES, SEASONAL SALES AND <br />TEMPORARY STRUCTURES, SECTION 14 -28, PERMIT REQUIRED, TO ELIMINATE SPECIAL <br />USE PARKS FROM THE REQUIREMENTS OF CHAPTER 14; AMENDING VARIOUS SECTIONS <br />30 AND 45 WITHIN CHAPTER 14 RELATED TO THE SALE OF ALCOHOLIC BEVERAGES <br />WITHIN CITY PARKS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to the second reading of Ordinance 12 -1373 <br />was published in the Orlando Sentinel on June 28, 2012. <br />Staff Presentation: Development Services Manager Sandra Smith, stated Ordinance 12 -1373 amends <br />Chapter 14 regarding amusements to accomplish two primary goals. She further stated that the first was to <br />exempt City parks that are designated Special Use Parks from the permitting requirements and criteria <br />established for special events, open air sales, open air food sales and seasonal sales within Chapter 14. She <br />added that policies will be adopted specifically to govern these types of parks. <br />Ms. Smith explained that the second task was to provide the Community Development Department with the <br />responsibility of processing permits for the sale of alcoholic beverages within the City's parks, rather than <br />having this task taken through the City Commission. She further explained that in addition, these amendments <br />would eliminate text related to the number of alcoholic beverage permits issued each year which is already <br />regulated by the State. <br />Ms. Smith advised that Resolution 12 -2391 designating Special Use Parks and establishing special event <br />
