•. t. _, ME <br />During this quarter, contract negotiations with Robbins Development Partners nearly <br />collapsed due to the developer's refusal to execute the development agreement (part one <br />of the three part contract). After threatening to terminate discussions, negotiations got <br />back on track with intense meetings over detailed contract language. Technical issues <br />being resolved include: Shell property brownfield condition, mitigation of excessive muck <br />conditions on the property, process time periods, easements, general access to parks <br />and pedestrian ways, public parking and the parking structure. Staff is now 90% <br />complete in the negotiations with Robbins Development Partners for the purchase of the <br />City Center property. Pending some outstanding geotechnical analysis, the contract will <br />be delivered to the City Commission for its consideration in April /May. <br />Staff completed negotiations with Chef Keith Keogh regarding a Letter of Intent to bring <br />the first of a new chain of casual dining restaurants, Estados 11, to the Lake Concord <br />property. The City Commission approved the plan which also included a commitment of <br />up to $920,000 for infrastructural improvements to the property, funded through the CRA. <br />Staff negotiated to secure the Sheldon Rubin property (Target outparcel on U.S. 17 -92) <br />for a price of $100,000 to complete City ownership of the three Target outparcels. With <br />its acquisition, a significant hurdle is removed from the ultimate redevelopment of these <br />parcels. <br />A Memorandum of Understanding was successfully executed between the cities of <br />Casselberry and Altamonte Springs and LYNX regarding FlexBus. Staff continues to <br />track the LYNX corridor study that is currently underway and its potential impacts on <br />transit systems within the City limits. <br />A Phase I environmental assessments were completed with detailed reports for the City <br />Center site as well as the Target outparcels. The findings were submitted to the EPA. In <br />addition, staff requested to proceed with Environmental Phase II assessments for both <br />properties since there are perceived and /or known contaminants onsite. <br />Staff prepared a 3 -part contract document including contract for sale, development <br />agreement and conceptual plan agreement and advanced these documents to Robbins <br />Development Partners. On December 17th, staff met with the Robbins group to discuss <br />the documents in detail. Revisions have been made and the documents have been sent <br />back to the developer for additional review. <br />Staff has also evolved the vision for the property based on the concept advanced by the <br />Robbins Group in order to incorporate desires of the Methodist Church, improve parking, <br />traffic flow, pedestrian access, park and open space and the potential to accommodate <br />up to 75,000 square feet of retail in addition to the 225 apartment units. <br />A proposed Memorandum of Understanding with the City of Altamonte Springs and LYNX <br />regarding Flex Bus was finalized for presentation to the City commission in January 2011. <br />ACTION ITEM 4: Pursue Public — Private Partnerships that support the development <br />of commerce and industry in Casselberry. <br />Efforts to locate a Wawa at the corner of Wilshire Blvd. and S.R. 436 ended due to the <br />failure of the developer to reach acceptable financial terms with the property owner at the <br />
