Resolution 13 -2469 — Granting Authority to the City Manager to Terminate the Agreement <br />with Central Florida Environmental Corporation for the North Winter Park Drive Phase II <br />Pro' ect <br />Introduction: Resolution 13 -2469 approves termination of the Agreement with Central Florida <br />Environmental Corporation (CFE) and authorizes the City Manager to provide notice to CFE terminating the <br />Agreement at the appropriate time through the appropriate document, if the City Manager determines in his <br />discretion that termination is required. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution <br />13 -2469. <br />MOTION: Vice Mayor Solomon moved to approve the Consent Agenda, as presented. <br />Motion was seconded by Commissioner Hufford. Motion carried unanimously <br />by voice vote 4 -0. <br />A. Second Reading of Ordinance 13 -1386 — Adoption of Capital Improvement Program <br />The City Cleric read Ordinance 13 -13 86 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO ADOPT THE FIVE YEAR <br />CAPITAL IMPROVEMENT SCHEDULE 2013 -2017 AS PART OF THE CITY'S COMPREHENSIVE <br />PLAN IN ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA <br />STATUTES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Hearing: The Notice of Public Hearing relative to Ordinance 12 -1386 was published in the Orlando <br />Sentinel on January 31, 2013. <br />Staff Presentation: Interim Community Development Director Sandra Smith gave a brief overview of the <br />item, stating that the Capital Improvement Element of the Comprehensive Plan sets out the location and timing <br />of capital projects to achieve and maintain adopted level of service standards for public facilities. She added <br />that the City is required to review this program and update the Capital Improvement Element on an annual <br />basis, and that the CIP must be adopted through an ordinance that is advertised as a public hearing in <br />accordance with Florida Statutes. She advised that the Ordinance had been approved on first reading on <br />January 14, 2013. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Interim Community Development Director recommended <br />adoption of Ordinance 13 -1386 on second reading. <br />
