Ordinance 12 -1383 — Amending Ordinance 12 -1382 Establishing New Sewer, <br />Reclaimed Water and Water Fees and Charges <br />The City Clerk read Ordinance 12 -1383 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; AMENDING CHAPTER 86, <br />UTILITIES, ARTICLE IL SEWER, DIVISION 3, SECTION 86 -72, SCHEDULE OF RATES AND <br />CHARGES, AND ARTICLE III, WATER, DIVISION 2, SECTION 86 -189, SCHEDULE OF RATES <br />AND CHARGES, OF THE CITY CODE OF ORDINANCES; CORRECTING A SCRIVENER'S <br />ERROR CONTAINED IN ORDINANCE 12 -1382 ADOPTED ON NOVEMBER 13, 2012, TO REVISE <br />WORDING IN SOME OF THE NEW SEWER, RECLAIMED WATER AND WATER FEES AND <br />CHARGES TABLES TO STATE "RE, FLECTS THE CHARGE PER 1,000 GALLONS "; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE." <br />Staff Presentation: City Manager Randy Newlon explained that on November 10, 2012 the Commission had <br />approved on second reading new rates for the City's water and sewer utility; however, during the revision of <br />the ordinance the language that spoke to the multiple on which those rates were applied was inadvertently <br />struck from the document. He explained that those rates are applied to each thousand gallons that a customer <br />uses and this ordinance being considered now would correct that scrivener's error and make the intent of the <br />ordinance whole. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Finance Director recommended approval of Ordinance 12- <br />13 83 on first reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 12 -1383. The following <br />individuals came forward: <br />Mr. James Fraleigh, 23 Teresa Court, voiced opposition to Ordinance 12 -1383 and expressed <br />concerns about the higher utility rates charged to customers outside the City limits. <br />Mr. John Casselberry, 700 South Lost Lake Lane, expressed concerns about the language in <br />the ordinance relating to the scrivener's error, and also suggested the possibility of utility rates <br />being stabilized across the board countywide at some point in the future. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 12 -1383. <br />
