CASSELBERRY CITY COMMISSION <br />Minutes of December 10, 2012 — Regular Meeting <br />Page 11 of 19 <br />MOTION: Vice Mayor Solomon moved to approve Ordinance 12 -1383 on first reading, as <br />presented. Motion was seconded by Commissioner Hufford. <br />Discussion: Commissioner Hufford clarified for the record that the service charge for utility customers in <br />unincorporated Seminole County was 25 %, meaning $25 for every $100. <br />Motion carried 4 -1 by voice vote, Commissioner Aramendia dissenting. <br />B. Ordinance 12 -1385 — Internet Cafe Moratorium <br />The City Clerk read Ordinance 12 -1385 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, IMPOSING A TEMPORARY <br />MORATORIUM FOR 180 DAYS ON THE ISSUANCE OF ANY BUSINESS TAX LICENSE, <br />PERMIT, CONDITIONAL USE APPROVAL, SITE PLAN APPROVAL, AND ANY OTHER <br />OFFICIAL ACTION OF THE CITY OF CASSELBERRY HAVING THE EFFECT OF <br />PERMITTING OR ALLOWING THE CONSTRUCTION AND /OR OPERATION OF CERTAIN <br />BUSINESSES WITHIN THE CITY OF CASSELBERRY, RELATED TO GAME ROOMS, <br />ARCADES, INTERNET CAFES, SWEEPSTAKES REDEMPTION CENTERS AND SIMILAR <br />INDOOR ENTERTAINMENT AND AMUSEMENT ACTIVITIES AS MORE SPECIFICALLY <br />DESCRIBED IN THIS ORDINANCE, EXCLUDING APPROVALS AND PERMITS FOR THE <br />CONTINUANCE OF AN EXISTING BUSINESS; THE TEMPORARY MORATORIUM SHALL <br />APPLY TO ALL REAL PROPERTY LOCATED WITHIN THE CORPORATE LIMITS OF THE <br />CITY OF CASSELBERRY; PROVIDING A PROCEDURE FOR EXTRAORDINARY HARDSHIP; <br />PROVIDING FOR SEVERABILITY, CONFLICTS, AND AN EFFECTIVE DATE." <br />Staff Presentation: Sandra Smith, Interim Community Development Director, gave a brief overview of the <br />item. She reminded the Commission that the City had a moratorium on internet cafes which was due to expire <br />on December 20, 2013. She explained that staff was requesting an additional 180 -day moratorium while <br />waiting for the courts to settle the pending litigation between Seminole County and Allied Vets. She added <br />that she was hoping there would be a resolution to the litigation sometime in the early part of the New Year. <br />She further stated that the moratorium was being requested to ensure time to deal with any issues that may <br />come from the resolution of the litigation. She advised that if approved on first reading, the ordinance would <br />be brought back for second and final reading at the January 28, 2013 meeting, and staff was requesting <br />Commission support of the ordinance. She also pointed out that the ordinance provided for one additional <br />180 -day extension of the moratorium after the July 27, 2013 expiration date. <br />Commissioner Miller inquired whether there was any end in sight regarding state legislation on this matter, as <br />he was aware Representative Plakon had filed something last year. Ms. Reischmann explained that there had <br />been some issues in terms of regulation, in light of the fact that Native Americans had the exclusive rights to <br />gambling. She stated she would research the status and would have an update for the commission at the time <br />of second reading of the ordinance. <br />Budget Impact: There is no impact to the City Budget, <br />
