CASSELBERRY CITY COMMISSION <br />Minutes of February 25, 2013 — Executive Session and Regular Meeting <br />Page 14 of 19 <br />situations and she and the City Clerk had obtained information from them about the process they followed. <br />Vice Mayor Solomon Sandy commended Commissioner Miller, stating she believed he was one of the best <br />commissioners that the City of Casselberry had ever had, it had been a pleasure to work with him and she <br />would miss him. She added that he always thought of the City first and was always thinking of ways to make <br />the City a better place. <br />Ms. Reischmann clarified for the Commission that no action to appoint someone to Commissioner Miller's seat <br />could take place until there was actually a vacancy, and there could also be no discussion about possible <br />appointees. <br />Discussion: Additional lengthy discussion ensued regarding what the effective date of the resignation should <br />be in order to allow for the most flexibility to consider a new appointee. Commissioner Miller indicated he <br />would be willing to amend his resignation date in the interest of what was best for the City, and to allow for <br />sufficient time to make a decision on an appointee. <br />Commissioner Hufford acknowledged Commissioner Miller for all he had done for the City, and the insights <br />and perspective he provided to the Commission. Commissioner Aramendia added his thanks to Commissioner <br />Miller, stating it had been an absolute pleasure to work with him, his perspective on numerous issues had <br />added so much to the Commission, and he wished him the best. Mayor Glancy also acknowledged <br />Commissioner Miller's contributions to the City, stating that he had brought a real balance to the Commission <br />and she was sorry to lose him, but happy for him as he moved on in his future. She added that he would leave <br />behind a legacy of not only his service on the Commission, but also on the Board of Adjustments when he first <br />moved into the City. She commended him on having done a stellar job. <br />Commissioner Hufford requested that the City Attorney read into the record the two Charter sections that <br />mandated what must be done in the event of a vacancy occurring on the City Commission, in order to clarify it <br />for the Commission and for the citizens in the audience. <br />Ms. Reischmann read those sections as follows: <br />Section 4.08 — Vacancy in the Office of City Commission Members. <br />"If any vacancy occurs in the City Commission, the City Commission shall fill the vacancy until the next <br />regular municipal election, at which time the vacancy in such office shall be filled for the unexpired term, if <br />any ... If the Commission fails to do so within 30 days following the occurrence of the vacancy, the City Clerk <br />shall call a special election to fill the vacancy, to be held not sooner than 90 days and not later than 120 days <br />following the occurrence of the vacancy, and to be otherwise governed by law." <br />Section 4.09 — Time limit for filling vacancies. <br />"Any vacancy in the office of the Mayor or Commission member shall be filled by action of the City <br />Commission not later than the second regular Commission meeting following the vacancy." <br />Discussion: Discussion ensued regarding some of the issues facing the City and the need for an appointment <br />to be made as expeditiously as possible to carry forward with some of the pending projects and issues; how the <br />
