Future Agenda Items <br />Commissioner Miller suggested that a discussion about the possibility of creating an overlay district for State <br />Road 436 to ensure that it's an economic development zone that would prohibit certain types of activities and <br />placements would be a good topic for a future agenda. <br />Commissioner Miller then announced that unfortunately he would be submitting his resignation from the <br />Commission at tonight's meeting due to work scheduling conflicts that were affecting his attendance at the <br />Commission meetings. He stated that he was proud of the work the Commission had done over the past six <br />years and the positive changes that had been made. He thanked everyone who had taken part in making those <br />changes happen. <br />Commissioner Miller urged the Commission to spare the City the expense of a special election and to appoint <br />someone they felt they could trust to help advance the City to a positive place, and easily step into the role of <br />Commissioner. He added that after discussions with the City Attorney, the recommendation was to make the <br />resignation effective March 12, 2013 at 12:00 a.m., in order to allow the Commission maximum flexibility in <br />making an appointment prior to the expiration of the 30 days after which a special election would be required <br />by the City's Charter. <br />Ms. Reischmann advised that the determination of selection was at the Commission's discretion and option. <br />She outlined various options, explaining that if the resignation were effective March 12, 2013 at 12:00 a.m., <br />under the City's Charter, a new Commissioner would have to be appointed by the April 15, 2013 in order to <br />meet the requirement of a 30-day limit for an appointment. She added that there is also a requirement for the <br />appointment to be made by the second regular meeting from the time of the resignation. She explained that if <br />either requirement was not met, then the lack of action would prompt the City Clerk to call a special election. <br />Discussion: Lengthy discussion ensued regarding the various options for appointment; the timing mandated <br />by the City's Charter; various options for notification to parties interested in being considered for appointment; <br />qualifications for appointees; and options for calling a special meeting. Ms. Reischmann explained that the <br />only mandated requirements for an appointee were 1) must be a resident for one year prior to the appointment; <br />2) must be a qualified elector; and 3) must be able to maintain residency during the term of office. Ms. <br />Reischmann also advised that the Cities of Palm Coast and Winter Springs had recently gone through similar <br />
