CASSELBERRY CITY COMMISSION <br />Minutes of January 14, 2013 — Regular Meeting <br />Page 13 of 23 <br />S. Excuse of Absence — Commissioner Jon Miller <br />Introduction: Commissioner Jon Miller has advised that he will be absent from the January 14, 2013 City <br />Commission meeting as he will be traveling out of town on a business trip to Tallahassee. He respectfully <br />requests that his Excuse of Absence be placed on the Consent Agenda for consideration. <br />MOTION: Vice Mayor Solomon moved to approve the Consent Agenda, as presented. <br />Motion was seconded by Commissioner Aramendia. Motion carried <br />unanimously by voice vote 4 — 0. <br />A. Second Reading of Ordinance 12 -1383 — Amending Ordinance 12 -1382 Establishing <br />New Sewer, Reclaimed Water and Water Fees and Charges <br />The City Clerk read Ordinance 12 -1383 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 86, <br />UTILITIES, ARTICLE II, SEWER, DIVISION 3, SECTION 86 -72, SCHEDULE OF RATES AND <br />CHARGES, AND ARTICLE III, WATER, DIVISION 2, SECTION 86 -189, SCHEDULE OF RATES <br />AND CHARGES, OF THE CITY CODE OF ORDINANCES; CORRECTING A SCRIVENER'S <br />ERROR CONTAINED IN ORDINANCE 12 -1382 ADOPTED ON NOVEMBER 13, 2012, TO REVISE <br />WORDING IN SOME OF THE NEW SEWER, RECLAIMED WATER AND WATER FEES AND <br />CHARGES TABLES TO STATE "REFLECTS THE CHARGE PER 1,000 GALLONS "; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE." <br />Notice of Hearing: The Notice of Public Hearing relative to Ordinance 12 -1383 was published in the Orlando <br />Sentinel on January 5, 2013. <br />Staff Presentation: City Manager Randy Newlon explained that just prior to the holidays the Commission <br />had heard and approved a rate change ordinance; however, in the rate change schedule which was approved, <br />some language had inadvertently been deleted which created the multiple on which the new rates would apply. <br />He explained this was simply a scrivener's error and staff had immediately brought this current ordinance to <br />the Commission on first reading to correct the error, and with Commission approval tonight the matter would <br />be settled. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Finance Director recommended adoption of Ordinance 12- <br />13 83 on second reading. <br />Public Hearing: The following individual came forward to address Ordinance 12 -1383: <br />Mr. James Fraleigh, 23 Theresa Court, spoke in opposition to any utility rate increase, stating <br />
