Yard waste. Vegetative matter resulting from landscaping maintenance or land clearing operations <br />and includes materials such as tree and shrub trimmings, weeds, plants, grass clippings, palm fronds, trees <br />and tree stumps. <br />Section 58.121. Public nuisance. <br />A. Declaration of a public nuisance. The following conditions on or within a property are hereby <br />prohibited and declared to be a public nuisance within the City of Casselberry when these conditions may <br />cause disease or affect the health, safety or general welfare of the citizens of the City. <br />1. Accumulations. The accumulation of debris, garbage, trash, or yard waste (as defined in Section <br />58 -120) on or within the land or premises of a property owner or occupant, including accessory <br />structures, patios, or the public rights -of -way adjacent to the land. <br />2. Excessive growth. The excessive arowth of arass. weeds. around cover and noxious plants on or <br />within the land or premises of a property owner or occupant. <br />a Excessive growth shall mean vegetation over ten (10) inches high covering the maiority of the <br />property that is or may reasonably become infested by pests or may create a fire or safety <br />hazard. <br />b) Excessive growth does not include the following unless the growth constitutes a fire or safety <br />hazard; <br />1 Shrubs, trees, or bushes (natural or cultivated) used for landscape purposes• <br />2 Vegetation located on a lot over one acre in area that is in a natural state, except as <br />required in Section 58- 121(Al(4); or <br />3) Vegetation located more than 200 feet from the boundary line of an improved property, <br />street or public right -of -way; or <br />4 Controlled, managed and maintained low- maintenance natural landscaping; or <br />5 The understory of hammocks that are protected through development regulations <br />conditions or agreements, and vegetation within wetlands, stormwater retention lake littoral <br />zones or within 150 feet of a regulated creek; or <br />6) Land designated agricultural or conservation on the future land use map. <br />3. Stagnant water. An accumulation of water that creates a serious threat to public safety due to noxious <br />odors or actual evidence of a breeding around for mosquitoes and vermin. <br />4. Failure to maintain a buffer area on undeveloped property. All undeveloped parcels of one acre or <br />larger in size shall be encircled on all sides by a 20- foot -wide buffer area to be maintained so the <br />height of the foliage or growth does not exceed 12 inches. When deemed advisable to protect the <br />health, safety and welfare of surrounding properties, the Fire Chief and Community Development <br />Director may require that the buffer area be reaularly Dlowed and disked for the protection of <br />roperty within the City. <br />B. General duties of property owners or occupants. <br />1 An owner or occupant shall reasonablv reaulate and effectively control accumulations of debris <br />aarbaae, trash, and yard waste, the excessive growth of vegetation, and the creation of stagnant <br />water as enumerated in this Section, on their property.
