A zonina amendment mav be proposed by the Citv Commission, by the Plannin <br />and Zoning Commission or by petition of the owners of 51 percent or more of the area included in the <br />proposed change. All proposals origjnatina L under the third category shall be submitted on a standar <br />application form accompanied by all pertinent information which may be required by the Planning and Zoning <br />Commission for proper consideration of the matter, along with payment of fees and charges as established by <br />the City Commission, <br />(2) Review of proposed amendments. All proposed amendments shall be submitted to the Planning and Zoning <br />Commission for study and recommendation. The Commission shall study these proposals to determine the <br />following information: <br />a. The need and justification for the change. <br />b. When pertaining to the rezoning of land, the effect of the change, if any, on the particular property and all <br />surround properties. <br />c. When pertaining to the rezoning of land. the amount of undeveloped land in the general area and in the <br />City having the same classification as that requested. <br />d. The relationship of the proposed amendment to the purpose of the City's general planning program, with <br />appropriate consideration to the proposed change as it affects any existing zoning and the City's general <br />planning program. and any and all conflicts therewith. <br />(3) Hearing by Planning and Zoning Commission. No recommendation for amendment of any zoning ordinance <br />shall be made by the Planning and Zoning Commission until and unless a public hearing has been held <br />ereon. Before any public hearing is held by the Commission, a notice of the hearing shall be published in <br />newspaper of general circulation within the City. Written notice of the time and place of the meeting and the <br />proposed action to be taken shall be posted upon the property under consideration and mailed to all owners of <br />record of property within 500 feet of the property requested for rezonjna. <br />4) Recommendation to City Commission. If the Planning and Zoning Commission makes no recommendatio <br />within 30 days, a written report as to the Commission's findings shall be submitted to the Citv Commission. <br />Upon the filing of the recommendations and report by the Planning and Zoning Commission, or upon its failure <br />to do so within 30 days with respect to any proposed amendment. supplement, change. modification or <br />appeal, the City Commission shall proceed to hold a public hearing in relation thereto, giving notice of the time <br />and place of the hearing. The notice shall be published in a newspaper of general circulation in the Citv. <br />51 Hearing and action by City Commission. When any change of zoning is proposed, the City Commission shall <br />old a public hearing thereon with due public notice as provided for in Subsection (4) of this Section.
