Whenever the secretary to the Planning and Zoning Commission has received a written request for a <br />continuance, delay or postponement of a public hearing from an applicant after the public hearing has <br />been duly advertised, the Planning and Zoning Commission may grant the applicant's request for <br />continuance, delay or postponement. <br />As a condition precedent to granting the applicant's request for continuance. delay or postponement, the <br />Commission may establish any fees that shall be necessary to cover all administrative and other <br />expenses resulting from the continuance. delay or postponement, The Commission shall reschedule the <br />hearing as soon as practicable, but in any event within the following 180 days. <br />c. Any further request for continuance, delay or postponement shall result in denial of the application for <br />rezoning, and the application shall be subiect to the provisions of Subsection t61 of this Section. <br />SECTION 4. The City of Casselberry Code of Ordinances, Part III, Unified Land Development Regulations, <br />Chapter I, General Administration, Article Il, Administration and Enforcement, Section 1 -2.1 Enforcement by <br />Administrative Official, shall be amended as follows: <br />D. Administrative appeals. Appeals of an administrative official's decision are determined by the <br />S ent Planning and Zoning Commission and may be initiated taken by any <br />person aggrieved or by any officer, board or agency of the City in the enforcement of this <br />ordinance. Appeals of finat decisions of the Planning and Zoning Commission are co s' e e <br />by the City Commission based on the criteria provided <br />addressed in Section 1- 2.6(E). <br />1, Timing and procedure for appeals. An appeal of an Administrative Official's <br />determin ation to the Beard- ef Adjust Planning and Zoning Commission shall be <br />taken within ten 1UO calendar days after rendition of the order, requirement or <br />determination by the Administrative Official to which the appeal is directed. For <br />purposes of computing the time for filing an appeal, the making of an order, <br />requirement, decision or determination by the Administrative Official shall be the date <br />at which a written, dated and signed instrument expressing such decision is filed in <br />the records of the Administrative Official. The original and one copy of the notice of <br />appeal on a form provided by the Administrative Official shall be filed with the <br />Administrative Official who shall forthwith transmit to the Beard of AdjustmeRt <br />Planning and Zoning Commission all the documents, plans, papers or other materials <br />constituting the record upon which the action appealed from was taken and the <br />original notice of appeal. <br />Hearing. Hearings on appeals to the Sear, of ndjustmeRt lannina and Zoning <br />Commission shall be held in conformity with the below -cited provisions: <br />a. Date of hearing for appeals.
