CASSELBERRY CITY COMMISSION <br />Minutes of June 11, 2012 — Regular Meeting <br />Page l I of 18 <br />MOTION: Vice Mayor Hufford moved to reduce the lien for case number CE -11 -02541 <br />from $3,550 to $600.00. Motion was seconded by Commissioner Miller. Motion <br />carried unanimously by voice vote 4 -0. <br />B. Requests for Reduction of Multiple Code Enforcement Liens — 1165 Quintuplet <br />Drive <br />Staff Presentation: Sandra Smith, Development Services Manager, stated consideration to reduce several <br />code enforcement liens on the property located at 1165 Quintuplet Drive for case numbers CE -11 -00766 (lien <br />amount $3,150 to $1,575), CE -11 -00794 (lien amount $7,125 to $3,563) and CE -11 -00795 (lien arnount <br />$7,800 to $3,900) for a total amount of $18,075 to $9,038 to be paid within 60 days is requested. <br />Ms. Smith advised that the first code compliance violation for overgrown property was observed on April 1, <br />2011, with subsequent violations for trash and debris and roof maintenance observed on April 5, 2011. She <br />explained that all of the cases were presented to the Code Enforcement Board at the June 2011 meeting and a <br />subsequent hearing was held by the Board on July 14, 2011 where fines were imposed. She further advised <br />that the violation for overgrown property was in compliance on September 29, 2011, the violation for trash and <br />debris was in compliance on March 6, 2012, and the violation for roof maintenance was in compliance on <br />April 2, 2012. She added that the property was in the foreclosure process. <br />Ms. Smith explained that at the May 10, 2012 Code Enforcement Board meeting, the Code Compliance staff <br />had recommended that the Board deny the reduction of the liens on case numbers CE -11 -00766 and CE -11- <br />00794, and reduce the lien from $7,800.00 to $6,300.00 on case CE -11- 00795, which would have reduced the <br />total lien amount from $18,075 to $16,575.00. She stated that the recommendation took into consideration that <br />the lender acquired title in August 2011 but final compliance was not achieved until March 2012 even though <br />the lender was registered with the City as the responsible party for maintenance during that period oftime. She <br />added that the Code Enforcement Board considered the facts, and based on testimony from the lender's <br />representative that the violations were prior to the lender acquiring title, voted to recommend to the City <br />Commission a reduction in the total amount of liens from $18,075 to $9,038. <br />Budget Impact: The impact to the City Budget would be income of $9,038.00 for the reduced fine payments <br />based on the Code Enforcement Board's recommendation. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />consideration of the Code Enforcement Board's recommendation to reduce the liens for case numbers CE -11- <br />00766 (lien amount $3,150 to $1,575), CE -11 -00794 (lien amount $7,125 to $3,563) and CE -11 -00795 (lien <br />arnount $7,800 to $3,900) for a total amount of $18,075 to $9,038 to be paid within 60 days. <br />Audience Input: No one came forward to address this item. <br />MOTION: Vice Mayor Hufford moved to reduce the lien for case number CE -11 -00766 <br />from $3,150 to $1,575. Motion was seconded by Commissioner Aramelldia. <br />Motion carried unanimously by voice vote 4 -0. <br />
