Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 4 -0. <br />MOTION: Vice Mayor Hufford moved to reduce the lien for case number CE -11 -00795 <br />from $7,800 to $3,900. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 4 -0. <br />C. Requests for Reduction of Multiple Code Enforcement Liens — 508 Zinnia Drive <br />Staff Presentation: Sandra Smith, Development Services Manager, stated consideration to reduce several <br />code enforcement liens on the property located at 508 Zinnia Drive for case numbers CE -10 -02317 (lien <br />amount $10,150 to $5,075), CE -11 -00609 (lien amount $11,500 to $5,750) and CE 11 -01181 (lien amount <br />$1,450 to $250) from a total of $23,100 to $11,075 to be paid within 60 days is requested. <br />Ms. Smith advised that a code violation occurred on the subject property in 2010 for trash and debris and the <br />case was presented at the December 9, 2010 Code Enforcement Board meeting. She stated that fines were <br />imposed at a subsequent hearing on January 13, 2011, and that the property was found to be in compliance on <br />July 8, 2011 after the City abated the violation at a cost of $210.81. <br />Ms. Smith further advised that two code violations occurred on the subject property in 2011. She stated that <br />the first violation was for a damaged fence, and the Code Enforcement Board originally heard the case on May <br />12, 2011 and imposed the fine at a subsequent hearing on June 9, 2011. She advised that the second violation <br />was for designated parking, and that it was first presented to the Board on June 9, 2011 and a subsequent <br />hearing was held on July 14, 2011 when fines were imposed. <br />Ms. Smith explained that this location was in the process of foreclosure, and Midfirst Bank was unable to cure <br />the violations until they had Rill control of the property. She advised that the Code Enforcement Board met on <br />May 10, 2012, and considering the facts, voted to recommend to the City Commission a reduction in the total <br />lien amount from $23,100 to $11,075 because of a change in ownership due to the foreclosure. <br />Budget Impact: The lien amount paid would be recognized in the City Budget as income received. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />consideration of the Code Enforcement Board's recommendation to reduce the liens. <br />Audience Input: No one came forward to address this item. <br />MOTION: Commissioner Aramendia moved to reduce the lien for case number CE -10- <br />02317 from $10,150 to $5,075.
