MOTION: Mr. Henson moved to find Respondent(s) in this case was/were in violation of City Code as <br />charged and failed to correct the violation by the time specified for correction by the Code Compliance <br />Officer; that the violation is now corrected and no fine imposed. Any violation of the same code by <br />Respondent(s) within FIVE (5) years from the date of this Order shall be treated as a repeat violation, for <br />which a fine of up to $500.00 per day maybe imposed. Ms. Hale seconded the motion. The motion passed <br />unanimously. <br />REQUEST FOR REDUCTION/WAIVER OF LIEN <br />Overgrown property, City Code Section 70-2(C~ <br />® CE-08-03078 2446 Harbour Way <br />Mr. Brown, Code Compliance Supervisor, gave testimony for the above case. <br />Todd Luna, 1401 Town Plaza; Winter Springs, FL realtor/listing agent advised the bank tools title of this <br />property January of 2012. It is the banks position, since they didn't have legal rights to go into the property <br />that the fine should not be theirs. <br />MOTION: Ms. Hale moved that the Board recommend to the City Commission that the lien will be <br />reduced in this case from $17,775.00 to $10,000.00, to be paid within 60 days of the commission's order or <br />the fine reverts to the original fine amount. The reason for this reduction is the extended time it tools to <br />come into compliance, the gravity of the situation and any other circumstances that the Board seems fitting. <br />Mr. Smith seconded the motion. The motion passed unanimously. <br />Roof maintenance, City Code Section 3-10.3 <br />® CE-10-00055 331 Kantor Blvd <br />Mr. Brown, Code Compliance Supervisor, gave testimony for the above case. <br />Elizabeth Hathaway, Century 21 Real Estate Professionals 382 W SR 434; Longwood, FL 32750, advised <br />she was at the meeting for the bank. As soon as the bank received the property in October of 2011 they <br />were sent out to inspect the damage. <br />MOTION: Ms. Hale moved that the Board recommend to the City Commission that the lien will be <br />reduced in this case from $17,475.00 to $10,000.00, to be paid within 60 days of the commission's order or <br />the fine reverts to the original fine amount. Winter Parlc Dr <br />Mr. Brown, Code Compliance Supervisor, gave testimony for the above case. <br />Rene Berg, Rene Berg Realty, 2420 N Umbria Dr, Sanford, FL and Janet Mansfield, ReMax Central <br />Realty, 300 Premier Blvd, Lalce Mary, FL addressed the Board. Mr. Berg addressed advised she was the <br />selling agent and the property is under contract and the buyer is waiting to close. Ms. Mannfield advised <br />she was the listing agent and in the beginning of October (2011) the lender started addressing the yard. <br />3~Page <br />
