MOTION: Mr. Henson moved that the Board recommend to the City Commission that, the lien will be reduced in this case from $3,600.00 to $2,500.00, to be paid within 60 days of the commission's order or the fine reverts to the original fine amount. The reason for this reduction is the extended time it tools to come into compliance, the gravity of the situation and any other circumstances that the Board seems fitting. Ms. Hale seconded the motion. The motion passed unanimously. CONTINUED CASES No tree permit, City Code Section 3-14.4 ® CE-11-02458 970 SR 436 Ms. Broman, Code Compliance Officer, gave testimony for the above case. Julius Lopez, 970 SR 436; Casselberry advised that when they cut the trees they did not know a permit was needed and upon finding out they immediately came and applied for the permit. MOTION: Mr. Herron moved to dismiss this case. Ms. Hale seconded the motion. The motion passed unanimously. Tree replacement requirements, City Code Section 3-14.8 A ® CE-11-02561 970 SR 436 Ms. Broman, Code Compliance Officer, gave testimony for the above case. MOTION: Mr. Henson moved that this case be continued to the 05/10/2012 Code Enforcement Board Meeting, or to the next regularly schedule meeting. Ms. Hale seconded the motion. CASES IN COMPLIANCE PRIOR TO HEARING Trash & debris, City Code Section 70-2(C) ® CE-11-02865 764 N Winter Parlc Dr Mr. Brown, Code Compliance Supervisor, advised that the above cases would not be heard due to compliance being achieved. NEW CASES No building~permit, City Code Section 1-4.3 ® CE-11-02554 227 Brighton Way Mr. Luis, Code Compliance Officer, gave testimony for the above case. MOTION: Mr. Smith moved to find Respondents in this case in violation of the City Code as charged and that Respondents correct the violation before 1:00 p.m. on 05/10/2012. In the event Respondent does not comply by this date, a fine in the amount of $25.00 per day will be imposed for each day the violation continues past the aforestated date. The Respondents are further ordered to contact the Code Compliance Officer to verify compliance with this Order. Ms. Hale seconded the motion. The motion passed unanimously. 4~Page
