Board of Adjustment <br />January 26, 2012 <br />Page 4 <br />A general discussion ensued regarding the existing 25 foot power line easement, the retention pond and the <br />building. Mr. Petersen said that the development is being moved closer to the road which requires redesigning the <br />retention pond. A discussion ensued regarding the retention ponds and the stormwater for the entire parcel and the <br />benefits to the Oxford Square Shopping Center, Old Time Pottery and the corner outparcel due to the retention pond <br />being located on the Waffle House site. <br />Mr. Larry Polliner, P.E., RCE Consultants, LLC, 617 Arvern Drive, Altamonte Springs, Florida came forward. Mr. <br />Polliner said they have tried to change the layout of the site. He said he met with St, Johns River Water Management <br />District regarding the site and if other than replacing the pond cut for cut it would require meeting the present stormwater <br />code requirements. He said the site was developed in 1984 and the codes were much different. He said to meet the <br />present standards the pond would need to be roughly 5 times the size of the current pond. He said they met with the City <br />Engineer and it was decided to leave the structure and recreate the volume of the pond. He said the Waffle House site <br />needs to match the same impervious area as the old Checkers site. He said they have tried numerous iterations and <br />there is no other way to lay out the site. <br />Mr. Polliner felt that the signage calculation was quoted incorrectly. He said it was quoted as 2 square foot per <br />linear foot of building frontage and did not add the additional information stating it was where the primary entrance was <br />located, He said that other existing businesses have their identity and the color of their building as part of their identity. <br />He said the Waffle House was guided to change their elevation and colors and they have lost their corporate identity at <br />this site. <br />Mr. Polliner said Crime Prevention through Environmental Design (CPED) means a design that eliminates or <br />reduces criminal behavior and at the same time encourages people to keep an eye out for each other and the proper <br />design and effective use of the built environment can lead to reduction in the fear and incidents of crime and the <br />improvement of the quality of life. He said it is specifically natural surveillance. He said if the building was placed at the <br />front of the property and the parking located at the rear of the site it would eliminate law enforcements' view of the parking <br />area. Mr. Polliner said CPED basically states to keep your visibility open. He said the plans that have been submitted for <br />permitting show maximum visibility. <br />Mr. Polliner requested the Board of Adjustment grant the variance to allow the additional signage, A general <br />discussion ensued regarding the signage calculations based on building frontage and not the primary entrance and <br />
