Resolution 11-2327 - Award of Bid and Agreement with Waste Pro of Florida, Inc. for Commercial Waste Containers, Hauling and Disposal for the City of Casselberry Facilities "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF THE AGREEMENT WITH WASTE PRO OF FLORIDA, INC. TO PROVIDE COMMERCIAL WASTE CONTAINERS, HAULING AND DISPOSAL FOR NINE (9) CITY OF CASSELBERRY FACILITIES; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." Introduction: Resolution 11-2327 provides for award of bid and an agreement with Waste Pro of Florida, Iuc. to provide commercial waste containers, hauling and disposal for nine (9) City of Casselbeny facilities at a monthly rate of $2,518.87. The agreement will commence on January 1, 2012, eliminating any lapse in seIvices. The agreement may be extended by mutual agreement of the City and Waste Pro of Florida, Inc. for additional terms of up to four (4) years, for a maximum contract term of up to five (5) years. Budget Impact: Funds are available and budgeted to cover the City's monthly waste services in the Streets & .Fleet Maintenance Construction Material Disposal Fund, the Solid Waste Fund, Other Contractual Services, and Water and Sewer Fetid, Water Reclamation -Other Contractual Services. Recommendation: The City Manager and the Public Worlcs Director recommended approval of Resolution 11-2327. E. Resolution 11-2328 -Encroachment A>reement with Mr. Leslie M. Davis, Jr. and Mrs. Barbara Davis - 1201 Lancelot Way "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND LESLIE M. DAMS, JR. AND BARBARA A. DAMS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." Introduction: Resolution 11-2328 provides for an Encroachment Agreement between Mr. Leslie M. Davis and Mrs. Barbara Davis and the City of Casselberry for property located at 1201 Lancelot Way. Acceptance and execution of the Encroachment Agreement will enable the Davis to replace a shed that was already located in the easement when they originally purchased the properly, and enable the City to utilize the easement should the need arise, holding the property owners responsible for removal costs when and if the City needs to install utilities in the easement. It is not feasible to position the proposed new shed outside the recar•ded easements due to existing site improvements (swimming pool). Budget Impact: There is no impact to the City budget.
