CASSELBERRY CITY COMMISSION <br />Minutes of January 23,2012 — Regular Meeting <br />Page 9 of 18 <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />OFFICIAL FUTURE LAND USE MAP, ESTABLISHING THE FUTURE LAND USE MAP <br />DESIGNATION OF MEDIUM DENSITY RESIDENTIAL (MDR) FOR THE PARCEL AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 11 -1366 was published in the <br />Orlando Sentinel on December 1. 201 <br />Staff Presentation: City Manager Barbara Lipscomb stated that Development Services Manager Sandra <br />Smith would be making the presentation for both Ordinance Nos. 11 -1366 and 11 -1367, relating to the land <br />use and zoning of 95 Concord Drive. She added that Ms. Smith will also be providing information about some <br />concerns staff has about this project which the Commission can use in making a decision. <br />Ms. Sandra Smith, Development Services Manager, presented information to the Commission relevantto both <br />the future land use amendment request relating to Ordinance No. 11 -1366 and the zoning map amendment <br />request relating to Ordinance No. I1 -1367. She explained that the subject property is one parcel of <br />undeveloped land located at 95 Concord Drive consisting of 1.76 total acres. <br />Ms. Smith further explained that currentlythe future land use designation for the properly is commercial, and it <br />has a comparable CG— Commercial General zoning designation. She stated that the proposed future land use <br />request is for medium density residential or residential development and the compatible zoning designation <br />would then be RMF 13, or residential multi - family. Ms. Smith advised that the Planning and Zoning <br />Commission, acting as the Local Planning Agency provided a recommendation of denial by a 4 -1 vote at their <br />November 9, 2011 meeting. Ms. Smith gave an overview of the land use and zoning of properties in the <br />surrounding areas and provided information on what the applicant is suggesting for development of the subject <br />properly. She reminded the Commission that this item had been continued from the last meeting, and at that <br />meeting a discussion was held about the possibility of the applicant entering into an agreement with the City <br />for development of the site to provide sonic ideas as to what might occur at the site. She stated that staff has <br />been working with the applicant to put the agreement together, and she referred the Commission to the draft <br />agreement contained in the packet, going over the factors that are included in the agreement for development of <br />the site. Ms. Smith also advised that a petition had been received from residents in the surrounding <br />neighborhoods in opposition to the amendments, and that the applicant, Mr. Anderson, was in attendance and <br />available for questions and discussion. <br />Ms. Smith concluded by stating that the amendments are consistent with the City's Comprehensive Plan, <br />compatible with the surrounding mix of zoning and land uses, and will not negatively impact the City's ability <br />to provide services and that Staff has recommended approval of the future land use amendment, as well as <br />compatible zoning designation to residential multi - family, RMF -13. <br />A copy of the presentation is attached to and made a part of these minutes. <br />Budget Impact: There is no impact to the City Budget. <br />
