The City Attorney stated this is a new innovative method <br />which is being utilized by many cities for this purpose, but it is somewhat controversial because it is based on <br />cost of abatement rather than a uniform assessment that is varied for all properties. Ms. Reischlnann stated she <br />will continue to monitor case law, but currently there is not any case law relating to the controversy. <br />Budget Impact: The collection of the City's costs to abate propel~ies will have a positive impact on the City's <br />Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Resolution 11-2310. <br />Public Hearing: Mayol• Glancy opened the public hearing relative to Resolution 11-2310. No one came <br />forward. Mayor Glancy closed the public hearing relative to Resolution 11-2310. <br />MOTION: Commissioner Solomon moved to approve Resolution 11-2310, as presented. <br />Motion was seconded by Commissioner Hufford. First Reading of Ordinance 11-1361 - Amending ULDR Section 3-16.4, On- <br />Premises Temporary Sign Regulations Related to Road Construction Projects (LPA <br />11,_,171 <br />The City Clerk read Ordinance 11-1361 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLROIDA, AMENDING THE CITY OF <br />CASSELBERRY CODE OF ORDINANCES PART ffi, SEC. 3-16.4, "ON PREMISES TEMPORARY <br />SIGN REGULATIONS", TO PROVIDE TEMPORARY SIGNAGE OPTIONS TO BUSINESSES <br />AFFECTED BY FUTURE CONSTRUCTION PROJECTS ALONG SR 436, U.S. HWY 17-92, AND <br />SEMINOLA BOULEVARD; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br />Staff Presentation: Ms. Sandra Smith, Development Services Manager, stated Ordinance 11-1361 provides <br />for amendment of the criteria provide in the City Code related to temporary signs for businesses during long- <br />term road construction projects along State Road 436, U.S. Highway 17-92 and Seminola Boulevard. Due to <br />the two major road construction projects that will be occurring within the City during the next few years on 17- <br />92 and 436, staff is proposing to expand the signage opportunities to include a banner for each tenant and one <br />site identification sign for each parcel. The Planning and Zoning Commission unanimously recommended <br />approval of Ordinance 11-1361 at its August 10, 2011 meeting. The City Commission conducted discussion <br />regarding this issue at their September 10, 2011 meeting and provided staff additional direction which has been <br />incorporated into the ordinance. <br />Budget Impact: There is no impact to the City's budget. <br />
