Hale made a motion to find Respondents in CEB Case # 08-01501 in violation of City Code, Section 3- <br />10.9 A,1,B,4 ,and that Respondents correct the violation before 1:00 pm 11/10/2008. Another Hearing will be held <br />before this Board on 11/13/2008 to determine compliance by the aforestated date, and, if there is no compliance by <br />the aforestated date, a fine in the amount of $25.00 per day will be imposed for each and every day the violations <br />continue past the aforestated date. The Respondent is further ordered to contact the Code Inspector to verify <br />compliance with this Order. <br />Robert C. Flint seconded the motion. <br />The motion passed unanimously. <br />NEW CASE <br />CE-08-01696 311 Concord Drive Roberts, Cynthia/owner Overgrown~roperty 70-2 (C <br />Michele Lawrence, Code Enforcement Officer gave testimony. This case is for overgrown and was brought to the <br />CEB about two or three months ago. The violator did comply before the deadline that they initially indicated, again <br />the property was found overgrown on 07/03/2008. A Notice of Repeat Code Violation was sent immediately. CEO <br />Lawrence stated she was not there to ask for a fine, she was there to ask that any further violations of overgrown at <br />this property be a repeat violation and asses fines. The property was found mowed on 08/12/2008. The property was <br />left overgrown from 07/02/2008 to 08/12/2008. CEO Lawrence described photos of the property. CEO Lawrence <br />stated the City was only asking that any further violations of this nature be considered repeat. <br />Alvera Armour, Vice-Chairperson asked if Ms. Roberts was in the audience. <br />CEO Lawrence stated that she was not present. <br />Discussion. <br />Charlene Glancy made a motion to find Respondent in CEB Case # 08-01696 was in violation of City Code, <br />Section 70-2 (C ); that the violation was corrected and recurred; and that any violation of the same code by <br />Respondent within FIVE (5) years from the date of this Order shall be treated as a repeat violation, for which a fine <br />of up to $500.00 per day may be imposed. <br />Kathleen A. Hale seconded the motion. <br />The motion passed unanimously. <br />Ketron Brown, Code Enforcement Supervisor, stated that the following case was already heard by the Board and a <br />Finding of Fact was made # CE-08-00348 for a Disabled/iJnlicensed Vehicle, violation of City Code Section 3- <br />10.9. The owner of the property is Cynthia Roberts, there has been a fine running at $25.00 per day, the fine is <br />currently at $1,925.00. The fine was imposed by the Board on 06/16/2008 and the violation still remains today. <br />CES Brown stated this is a Homestead property and the City would not be able to foreclose for that reason. CES <br />Brown stated the City was looking for a Motion of an Administrative Order directing the City of Casselberry, <br />Police Department to tow the vehicle to remedy the violation since the owner has no intent to do so. <br />Robert C. Flint asked if the car is on their property. <br />CES Brown stated yes. <br />
