CITY OF CASSELBERRY <br />CODS, ENFORCEMENT BOARD MEE ~ LNG <br />AUGUST 14, 2008 PAGE 10 <br />Mr. Flint asked if the City had right to go onto their property. <br />CES Brown stated that 162.8 gives the Board the authority to issue any Order with the force of law to remedy a <br />violation. <br />Katie Reischmann, City Attorney stated when it is a nuisance type condition, then the statute does allow you to <br />abate the nuisance. <br />Phillip E. Weekley asked if an abandoned car in a driveway is considered a nuisance to the City. <br />Discussion. <br />Mr. Flint asked when we tow the vehicle off, the fine ceases at that time but how do we recoup the fines for the <br />service. <br />CES Brown stated the City would record a lien for the cost of the service of removing the vehicle along with <br />administrative costs. <br />Mr. Weekley asked if there are storage fees associated now that it is being towed. <br />CES Brown stated the storage fees would run against the homeowner and they would elect to pay the storage fees <br />and get the vehicle returned or it would be abandoned and there is a procedure for the wrecker companies to get <br />title of the vehicle and then sell it. <br />Charlene Glancy asked if the owner would be notified ahead of time that the vehicle will be towed by a certain date. <br />CES Brown stated the City would ask for a speedy date. <br />Ms. Reischmann stated we do need to notify the owner. <br />CES Brown stated if the Board issues the Order and the copy is served on the owner giving them a week to comply <br />or the order will be enforced, the City has no problem~with that. <br />Discussion. <br />Robert C. Flint made a motion in CEB Case # 08-00348 to issue an Administrative Order to allow the Police <br />Department to tow the abandoned vehicle referenced in the above case by 08/28/2008 in accordance with Code, <br />changed to 2 weeks or in accordance with City of Casselberry Code. <br />Charlene Glancy seconded the motion. <br />The motion passed unanimously. <br />
