CITY OF CASSELBERRY ' <br />CODE ENFORCEMENT BOARD MEETING <br />August 14, 2008 PAGE 6 <br />Alvera Armour, Vice-Chairperson asked if the owner or a representative was present at the 08/14/2008 Hearing. <br />There was no one present. <br />Charlene Glancy made a motion to find Respondent in CEB Case # 08-01497 in violation of City Code, Section 70- <br />2 (C ), and that Respondent correct the violation before 1:00 pm 09/01/2008. Another Hearing will beheld before <br />this Board on 09/11/2008 to determine compliance by the aforestated date, and, if there is no compliance by the <br />aforestated date, a fine in the amount of $25.00 per day will be imposed for each and every day the violations <br />continue past the aforestated date. The Respondent is further ordered to contact the Code Inspector to verify <br />compliance with this Order. <br />Kathleen A. Hale seconded the motion. <br />The motion passed unanimously. <br />Mr. Weekley asked if there is a standing order to bill these homeowners for the mowing service. <br />CES Brown stated the City records a lien, administrative costs are also added to the lien. <br />NEW CASE <br />CE-OS-01501 320 Secret Way Court Hines, Ronald & Merry/owners Parking large <br />vehicle(s) (dump trucks, wreckers ETC. 3-10.9 A,1,B,4 <br />Luis Rivera, Code Enforcement Officer gave testimony. On 06/19/2008 CEO Rivera observed a dump truck parked <br />on the side of the property and Notice of Code Violation was sent to the property owners. Several days later the <br />owner of the property was present at City hall at which time CEO Rivera spoke to him. The owner indicated he <br />wanted to come to a Hearing were he could be heard and have his say about the truck. Although this is a dump <br />truck the owner claims he uses it as a private vehicle and not as a work vehicle. During subsequent inspections on <br />07/03/2008, 07/23/2008, 07/30/2008 and the morning of 08/14/2008 revealed the vehicle is still parked at the <br />location. <br />Katie Reischmann, City Attorney swore in property owner Ronald Hines. <br />Ron Hines, 320 Secret Way Court, Casselberry, FL gave testimony. Mr. Hines advised that this is the vehicle he <br />drives back and forth to work and that it represents him personally in the community. Mr. Hines continued. Mr. <br />Hines stated he did not ask to come to a Board meeting, CEO Rivera asked him. Mr. Hines continued. <br />Robert C. Flint stated the City of Casselberry is the one that instituted the rules and regulations that they are sworn <br />to enforce for this community. The City of Casselberry is everyone who was in the audience and all of Mr. Hines <br />neighbors as well and they have determined that trucks, specifically utility bed trucks, dump trucks, vehicles with <br />three or more axels, trucks without a bed are not in compliance with City of Casselberry community regulations. So <br />therefore Mr. Hines is in violation of the City of Casselberry Code, its black and white. <br />Mr. Hines stated to Mr. Flint, let me explain to you black and white. Mr. Hines stated black and white is back <br />before the neighborhood was built, he was told this was ok and now they have just changed and come out with <br />some new rules and regulations. Mr. Hines asked Mr. Flint if that was correct. <br />Mr. Flint stated that was correct, The City has done that; your City has done that. <br />
