CITY OF CASSELBERRY <br />CODL ENFORCEMENT BOARD MEE 1 LNG <br />AUGUST 14, 2008 PAGE 5 <br />Robert C. Flint asked what the City recommendation was. <br />Ketron Brown, Code Enforcement Supervisor stated the city was requesting a Finding of Fact be imposed as well <br />as a fine to cover administrative cost of the six inspections the City had made to bring the property into compliance. <br />Mr. Flint stated that based on criteria the fine would have to be imposed as of 06/10/2008, in the amount of $25.00 <br />based on standard criteria for repeat violation. He asked if that is what CES Brown was recommending. <br />Charlene Glancy asked, you impose a set fine and not a per day fine. <br />Mr. Flint stated the direction is you are to impose the fine that was previously set from the previous violation and <br />impose it effective the date of the new violation till the date it was corrected. <br />Discussion. <br />Ms. Reischmann stated the Board did not have to do that, it is at their digression that is what you can do since it is a <br />repeat. <br />Charlene Glancy asked if there was a way to help the CEB out with a dollar amount to cover the administrative fee. <br />CES Brown stated the administrative fees for the City was roughly $25.00 per inspection, $50.00 processing fee for <br />Certified mailings, clerical time, copies, and also a $10.00 fee for recording with the Clerk of the Court. <br />Discussion. <br />Robert C. Flint made a motion in CEB Case # 08-01397, to find Respondent was in repeat violation of City Code, <br />Section 70-2 (C ), pursuant to the Board's original Order of 04/19/2005. A fine in the amount of $250.00 is hereby <br />imposed for the days of repeat violation. <br />Kathleen A. Hale seconded the motion. <br />The motion passed unanimously. <br />NEW CASE <br />CE-OS-01497 641 Crestview Drive Kizzort, Betty/owner Overgrown property 70-2 (C ) <br />Luis Rivera, Code Enforcement Officer gave testimony. The violation was first observed on 6/18/2008 by CEO <br />Rivera, a door hanger was left at the location. On 06/24/2008 there was afollow-up inspection, the violation still <br />existed, and a Notice of Code Violation was sent to the property owner with a compliance date of 07/04/2008. On <br />07/09/2008, 07/17/2008, and 07/22/2008 the property was inspected all inspection revealed no changes. On <br />07/23/2008 the property was inspected once more and the case was forwarded to Brenda Jones to be scheduled for <br />the next Code Board Hearing and for the contractor to service the location. Also on 07/23/2008 the mail sent to Ms. <br />Kizzort was returned to the City as return to sender. On 07/29/2008 the property was mowed by the contractor and <br />is now in compliance as a result of being serviced by the contractor. There has been no compliance, contact, or <br />correspondence from the property owner. <br />Discussion. <br />
