CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />AUGUST 14, 2008 PAGE 4 <br />REPEAT VIOLATION <br />CE-08-01397 790 Bavou Drive Dellamore, William E Overgrown prouerty 70-2 (C <br />Luis Rivera, Code Enforcement Officer, stated this case is being addressed as a repeat violation. The original case <br />CE-OS-00331 in 2005 at the location of 790 Bayou Drive, the violation is overgrown property. There was a <br />violation of overgrown property on 02/16/2005 first observed by former CEO Thompson; 04/19/2005 Affidavit of <br />Notice of Code Violation was sent Certified mail to the property owner with a date certain of 05/12/2005 for <br />compliance. A Hearing was held on 05/12/2005, the property owner was found in violation by the CEB, a date <br />certain of 05/26/2005 for compliance or a fine of 25.00 per day would be imposed. <br />The property was found non-compliant during inspection on 05/26/2005. On 06/09/2005 there was afollow-up <br />inspection, found non-compliant also date of Subsequent Hearing, at this Hearing the CEB imposed the fine of <br />$25.00 per day. On 08/25/2005 there was an inspection prior to Hearing/foreclosure decision. This violation was <br />found in compliance during this inspection. The fine on this property ran for 91 days at $25.00 per day totaling <br />$2,275.00. On 11/10/2005 there was a Hearing on Request for Reduction/Waiver of Lien, at this Hearing the CEB <br />reduced the fine to $227.00(fine listing shows $150.00). There were three fines at the time for this address and they <br />were reduced to a total of $500.00 and split $150.00 for 2 cases and $200.00 for the other case. All three cases were <br />paid with one check on 12/21 /2005. <br />On 06/10/2008 repeat violation first observed by CEO Rivera when he drove past the location that the property was <br />overgrown. Contact was made with the property owner, William Dellamore. A verbal warning was given and <br />requested compliance by 06/17/2008. CEO Rivera returned to the location on 06/19/2008 at that time he spoke to <br />the daughter. The location was still in violation. Mr. Dellamore's daughter stated he was at work. On 07/02/2008 <br />there was a reinspection, there was no change. Another inspection on 07/15/2008 showed there had been no change <br />at that time the case was forwarded to Brenda Jones to be heard at the CEB. On 07/25/2008 the property was <br />reinspected and photos were taken, there had been no change. On 07/29/2008 the property was reinspected, all but <br />the back of the property had been mowed, another photo was taken. On 08/12/2008 Mr. Dellamore contacted CEO <br />Rivera to notify that the property had been mowed on 08/09/2008, Mr. Dellamore asked if he had to appear before <br />the CEB. CEO Rivera informed him that he did, due to the case being a repeat violation. Mr. Dellamore was not <br />sure if he could attend. <br />Alvera Armour, Vice-Chairperson asked if Mr. Dellamore had any comments. <br />Katie Reischmann, City Attorney swore in Mr. Dellamore. <br />William Dellamore 790 Bayou Drive, Casselberry, FL stated be is a diabetic and has a heart condition. At one time <br />he had a kid in the neighborhood to cut the lawn, but he moved away. Mr. Dellamore now has someone to cut the <br />lawn. Mr. Dellamore stated he had cut the lawn himself; he has good days and bad days. Mr. Dellamore continued. <br />Discussion. <br />Phillip Weekley asked CEO Rivera when was the last time he looked at the property. <br />CEO Rivera stated it was the day Mr. Dellamore had called him. <br />Discussion. <br />
