There was death in <br />her family therefore she did not attend the 08/14/2008 CEB Hearing. The observation was made by CEO Broman <br />on 05/28/2008 after a neighbor called in the violation. CEO Broman went to the property and verified the property <br />was overgrown, and thru the slats in the fence could see the swimming pool was not being maintained. Notice of <br />Code Violation was mailed on 06/25/2008, Second Notice mailed on 06/27/2008, requesting date certain for <br />compliance of 07/10/2008. Affidavit of Notice of Code Violation and Request for Hearing saw sent 07/17/2008 <br />following non-compliance on 07/10/2008, sent Certified mail, posted on property and at City hall as required for <br />legal service. Certified mail has been received back to the City as unclaimed, lis pendens has also been filed on this <br />property within the last month. As of 08/14/2008 the property remains non-compliant, CES Brown then described <br />the case photos. The City requested a Finding of Fact for the stagnant water and trash & debris, City Code 70-2 (C <br />), CES Brown continued. <br />Alvera Armour, Vice-Chairperson asked if Mr. Finch was present at the 08/14/2008 Hearing. No one in the <br />audience responded. <br />Charlene Glancy asked Mr. Brown if he said the City had not been able to contact the owner. She also stated lis <br />pendens had been filed on this property. <br />CES Brown stated there had been no contact. Service was provided thru returned mail and posting on the property, <br />which someone had picked up, not sure who. <br />Kathleen A. Hale asked if the fence around the pool was secure. <br />CES Brown stated yes it was. ' <br />Ms. Hale asked if the City had a way to deal with mosquitoes since it is breeding season. <br />CES Brown stated the Public Works Deparhnent has chlorine tablets that can be put into the pool to help deter the <br />growth of mosquito larva. <br />Ms. Hale asked if both the pool and spa would be done and if the cost for this service would be included with the <br />Lien. <br />CES Brown stated yes. He then asked the Board for an Administrative Order for the tabs to be added to the pool <br />and the spa by Public Works. <br />Paul L. McKernan made a motion to find Respondent in CEB Case #'s 08-01203 & 08-01204 in violation of City <br />Code, Section 70-2 (C ), and that Respondent correct the violation before 1:00 pm 09/08/2008. Another Hearing <br />will be held before this Board on 09/11/2008 to determine compliance by the aforestated date, and, if there is no <br />compliance by the aforestated date, a fine in the amount of $50.00 ($25.00 each case) per day will be imposed for <br />each and every day the violations continue past the aforestated date. The Respondent is further ordered to contact <br />the Code Inspector to verify compliance with this Order. <br />Charlene Glancy seconded the motion. <br />Mr. McKernan then added that the City would take care of the problem by the date certain if the owner did not due <br />so, as well as added to the cost of the fine. This was seconded by Charlene Glancy as well. <br />The motion passed unanimously. <br />
