Boartl of Adjustment <br />October 27, 2011 <br />Page 3 <br />applicant's request for waiver of the required 6 month waiting period for re-application to the Administrative Official, Ms. <br />Wallace seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: BA 11.08: 204 SR 436 -Waffle House. Appeal of a determination by the Administrative <br />Official related to the calculation of allowable signage copy area. <br />Mr. Guzman asked the applicant to come forward, Mr. Ryan Peterson, 5986 Financial Drive, Norcross, Georgia <br />came forward. Mr. Peterson stated an Administrative Official's Determination was requested to determine the signage <br />calculation for the Waffle House site, Mr, Peterson explained that the ordinance states that the business is allowed two <br />square feet for each linear feet of building frontage where the primary entrance is located. He said that language was <br />used to determine the amount of signage allowed for the site and that information was presented to their Board for <br />approval to move forward with the project. Mr, Peterson explained that the City calculates the road frontage side to <br />determine signage, Mr, Peterson said the primary entrance is located on the non road frontage side of the building. He <br />said the building frontage is defined within the context of that section where it specifically states two square feet copy <br />area for each linear foot of building frontage where the primary entrance is located. <br />Mr. Peterson said there is 87,4 linear feet on the side where the primary entrance is located which would allow <br />174.5 square feet of total signage for the site. Mr, Peterson said that Waffle House is proposing 142 square feet of <br />signage, He said Waffle House is not asking for a variance for additional signage but to be allowed what is specifically <br />stated in the ordinance to allow the signage to be calculated based on the building frontage where the primary entrance is <br />located, <br />In response to the Board's question, Mr. Peterson stated there is 25 linear feet of building frontage on State <br />Road 436 and would provide significantly less signage and impact the viability of the project. Mr, Peterson stated that an <br />architecturally enhanced building would be constructed on the site, He said the restaurant is at a disadvantage because <br />it is not using the traditional Waffle House building design; therefore, the signage becomes more critical. <br />In response to the Board's question, Mr. Peterson stated based on his interpretation of the Code the site is <br />allowed 174.5 square feet of signage and Waffle House is proposing 142 square feet of signage. He said based on the <br />City's determination to use the road frontage 50 square feet of signage would be allowed. <br />In response to the Board's question, Mr. Peterson said if the City's interpretation of the Code prevailed they <br />would have to go back to their Board to seek approval.
