Board of Adjustment <br />October 27, 2011 <br />Page 2 <br />replace approximately 180 linear feet of insufficient T12 fluorescent illuminated canopies around the building with more <br />efficient LED lighting. She said the arches were designed to mimic the old mission roof lines and the arches provide their <br />customers and site with more efficient lighting and increase safety, Ms. Scott explained that sales were expected to <br />decrease during the remodeling but upon completion the expected sales would not only return to normal but increase <br />marginally, She said the sales have not recovered as expected at this site compared to other remodeled restaurants. <br />She said sales are down 10% below projections with a large portion of those sales being lost during the evening hours <br />which we feel is due to the absence of the arches causing low visibility. <br />Ms. Scott said at the public hearing on August 25, 2011, the Board was unable to consider the arches as <br />building lights as that information was not provided for the initial review by the administrative official; therefore, we <br />respectfully request a waiver of the six month waiting period for re-application. <br />Mr, Eric Raasch, Planner, reviewed the background information and the analysis of the request, provided in his <br />memorandum to the Board of Adjustment, dated October 27, 2011 (a copy is on file in the Community Development <br />Department). <br />Mr, Raasch said Staff recommends that the Board of Adjustment deny the request for a waiver of the six month <br />waiting period for re-application to the Board of Adjustment. He said if the Board of Adjustment chooses to waive the six- <br />month waiting period for re-application, an advertised public hearing will take place at a future meeting to revisit the <br />appeal of the determination of the Administrative Official. <br />A brief discussion ensued regarding the applicant's ability to appeal the Board of Adjustment's decisions made <br />at the August 25, 2011 meeting and tonight's decision within a 30 day period, <br />Mr. Guzman asked if there was anyone in the audience who wished to speak in favor of the request, No one <br />came forward. <br />Mr, Guzman asked if there was anyone in the audience who wished to speak in opposition to the request.
