Mr. Van Meter seconded the motion. <br />The motion passed unanimously by voice vote. <br />Twelfth Item of business: LPA 11.08: Demolition Process. Amending the Unified Land Development <br />Regulations to add new section to Article IV, building Code, Section 7, related to "Cessation of <br />Wor~/Expiration of building permit." <br />Ms. Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated May 11, <br />2011, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Ms. Smith stated that the City adopted the Florida Building Code (FBC) and it provides language for <br />the validity of a building permit. Ms. Smith said FBC Section 105.4.1., Permit intent, states that a building permit is <br />valid for six months, or for a period of six months after the last inspection and Section 105.4.1.2 states that a new <br />permit is required within 180 days from the date the initial permit expires or the building official is authorized to <br />require that any work which has been commenced or completed be removed from the building site. Ms. Smith <br />explained that this type of declaration requires a condemnation and demolition process. She said the FBC provides <br />that type of process however it is under "unsafe" structure. Ms. Smith stated it is not appropriate to use that <br />particular process because these buildings may not be deemed as an "unsafe" structure, Ms. Smith stated that the <br />City Attorney has advised staff to provide an alternate method for condemnation and demolition outside the FBC <br />process for unsafe structure demolition. <br />Ms, Smith stated that the City Attorney and the City's Building Official have reviewed the draft ordinance and <br />some revisions have been made to the ordinance that was provided in the agenda packet. Ms. Smith reviewed the <br />revised ordinance (a copy is attached and made a part of the minutes). Ms. Smith stated that a special assessment <br />has not been adopted at this time; therefore, she is eliminating the reference in the ordinance for "special <br />assessment" in Section 1-4.7(B)3(a)5. <br />After a brief discussion, Mr. Parkhurst asked if there was anyone in the audience who wished to speak in <br />favor of, or in opposition to, the request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida <br />came forward. Mr. Casselberry expressed a concern regarding receiving the proper authorization to demolish <br />buildings. Mr. Casselberry thought that the fees for demolition permits for properties owned by the Florida <br />
