Ms. Smith explained that a dock requires a conditional use and this property never received conditional use approval; therefore, a building permit could not be issued until a conditional use was approved for the property. She said if a property has received conditional use approval for a dock, a building permit could be issued to replace an existing dock. A brief discussion ensued regarding the lighting requirement for docks. Mr. Parkhurst asked for a motion to address CU 11-06. Mr. Aramendia made a motion to approve CU 11-06 residential dock at 141 South Triplet Lake Drive based on the staff report dated May 6, 2011 from Mr. Sorensen to the Planning and Zoning Commission as presented. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. Ninth Item of Business: LPA 1101: Annual Capital Improvement Schedule 2010111- 2014115. Consideration of an ordinance amending the Comprehensive Plan to incorporate the annual update to the Capital Improvement Element (CIE) required by Rule 9J-5.016, FAC, and Chapter 163, Part II, F.S. Ms, Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated May 11, 2011, to the City of Casselberry Local Planning Agency (a copy is on file in the Community Development Department), Ms. Smith stated that there has been some recent legislation in Tallahassee that no longer requires the Capital Improvement Schedules to be financially feasible and it does not require review by the Department of Community Affairs. She said it only requires adoption by ordinance. Ms, Smith explained that nothing was changed in last year's approved budget. She said this is procedural and informational for the Department of Community Affairs. Ms. Smith said Staff recommends that the Local Planning Agency hold a Public Hearing for consideration of this ordinance to amend the Comprehensive Plan to incorporate the annual update to the Capital Improvement Element (CIE) required by Rule 9J5016FAC and Chapter 163 Part II FS and provide a favorable recommendation to the City Commission. Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward.
