Planning & Zoning Commissionl <br />Local Planning Agency <br />May 11, 2011 <br />Page 6 <br />In response to the Commission's question, Ms. Smith stated that site plan review is not required for docks. <br />Ms. Smith explained that a dock requires a conditional use and this property never received conditional use approval; <br />therefore, a building permit could not be issued until a conditional use was approved for the property. She said if a <br />property has received conditional use approval for a dock, a building permit could be issued to replace an existing <br />dock. A brief discussion ensued regarding the lighting requirement for docks. <br />Mr. Parkhurst asked for a motion to address CU 11-06. Mr. Aramendia made a motion to approve CU 11-06 <br />residential dock at 141 South Triplet Lake Drive based on the staff report dated May 6, 2011 from Mr. Sorensen to <br />the Planning and Zoning Commission as presented. Mr. Van Meter seconded the motion. The motion passed <br />unanimously by voice vote. <br />Ninth Item of Business: LPA 1101: Annual Capital Improvement Schedule 2010111- 2014115. Consideration <br />of an ordinance amending the Comprehensive Plan to incorporate the annual update to the Capital <br />Improvement Element (CIE) required by Rule 9J-5.016, FAC, and Chapter 163, Part II, F.S. <br />Ms, Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated May 11, <br />2011, to the City of Casselberry Local Planning Agency (a copy is on file in the Community Development <br />Department), Ms. Smith stated that there has been some recent legislation in Tallahassee that no longer requires <br />the Capital Improvement Schedules to be financially feasible and it does not require review by the Department of <br />Community Affairs. She said it only requires adoption by ordinance. Ms, Smith explained that nothing was changed <br />in last year's approved budget. She said this is procedural and informational for the Department of Community <br />Affairs. <br />Ms. Smith said Staff recommends that the Local Planning Agency hold a Public Hearing for consideration of <br />this ordinance to amend the Comprehensive Plan to incorporate the annual update to the Capital Improvement <br />Element (CIE) required by Rule 9J5016FAC and Chapter 163 Part II FS and provide a favorable recommendation to <br />the City Commission. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />
