Amending the City of <br />Casselberry Code of Ordinances, Part II, Section 10.7, Sale near churches, educational institutions and other <br />businesses, to exempt restaurants that derive at least 51% of gross revenue from the sale of food and <br />nonalcoholic beverages from distance separation requirements fora 2COP Alcoholic Beverage License. <br />Mr. Eric Raasch, Planner I, reviewed the information provided in his memorandum dated March 9, 2011, <br />supported by a PowerPoint presentation, to the City of Casselberry Planning and Zoning Commission (a copy is on <br />file in the Community Development Department). Mr. Raasch stated that the change to the Code would provide an <br />exemption for distance separation for restaurants holding a 2COP alcoholic beverage license that derives 51 percent <br />of gross revenue from the sale of food and nonalcoholic beverages. <br />Mr. Raasch stated that the Code directly outlines measurement standards for churches and educational <br />institutions, but fails to address measurement from bars, lounges and bottle clubs. He said the proposed ordinance <br />would provide the method of measurement to the nearest entrance to such an establishment. <br />Mr. Raasch requested the Planning and Zoning Commission provide a favorable recommendation to the <br />City Commission to amend the City of Casselberry Code of Ordinances, Chapter X, Alcoholic Beverages, Section 10- <br />7, Sale near churches educational institutions and other businesses; to exempt restaurants that derive at least 51 <br />percent of gross revenue from the sale of food and nonalcoholic beverages from distance separation requirements <br />fora 2COP alcoholic beverage license. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address LPA 11-07. Mr. Aramendia provided a favorable <br />recommendation to the City Commission for LPA 11-07 from the Local Planning Agency based on the staff report <br />dated March 9, 2011 from Mr. Raasch to the Local Planning Agency as presented.
