Conditional use request to allow the consumption of alcoholic <br />beverages in conjunction with a restaurant operation in a CG zoning district. Property located at 1455 State <br />Road 436, Casselberry, Florida. <br />Mr. Eric Raasch, Planner I, reviewed the information provided in his memorandum dated February 4, 2011, <br />to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Mr. Raasch presented a PowerPoint Presentation (a copy is attached and made a part of the minutes). <br />Mr. Raasch said upon review of the conditional use request, the Planning and Zoning Commission's approval of CU <br />11-01 to allow the on-site consumption of alcoholic beverages as allowed by the 2COP state license, in conjunction <br />with the operation of a restaurant located at 1455 State Road 436 Suite 283, would be based on the findings of fact <br />and conclusions of the staff report dated February 4, 2011, and the following conditions: <br />1. The conditional use shall be limited to the location of 1455 State Road 436, #285. <br />2. The conditional use shall be limited to Hot Stone Restaurant. <br />3, All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />4, Package sales of alcoholic beverages for off-site consumption are prohibited. <br />5. The hours of alcohol sales shall comply with the hours set forth in Section 10-2 of the City of <br />Casselberry code. <br />6. Alcohol sales shall be ancillary to food sales. <br />7. The business shall remain incomplete compliance with all City, County and State requirements. <br />8, There shall be no outside display or storage of goods, materials, services or vehicles. <br />9. The conditional use shall commence within 90 days of the approval. <br />10. The conditional use shall expire if the use is discontinued for more than 90 days. <br />11. All signage requires additional permit approval and must comply with all City requirements. <br />12. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />A brief discussion ensued regarding the distance separation for alcohol sales for restaurant uses. Mr. <br />Raasch stated that staff is working with the City Attorney to modify the code to address the distance separation <br />required for restaurant uses. <br />Mr. Aramendia asked the applicant to come forward. The applicant had nothing to add to staffs <br />presentation. <br />
