All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address CU 10-09. Mr. Aramendia made a motion to approval CU 10- <br />09 Del Dios Bistro as presented. Mr. Van Meter seconded the motion. The motion passed unanimously by voice <br />vote, <br />Sixth Item of Business: CU 10-10: Lake Drive Assisted Living Facility. Request to extend conditional use <br />approval. Property located at 1316, 1324 and 1332 Lake Drive, Casselberry, Florida. <br />Ms, Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated December <br />8, 2010, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Ms. Smith said Staff supports the applicants request to extend the conditional use <br />approval for CU 08-12, Lake Drive Assisted Living Facility, from December 10, 2010 to December 10, 2011. Ms. <br />Smith stated that the Planning and Zoning Commission's motion to approve the extension request for CU 10-10 for <br />the Lake Drive Assisted Living Facility proposed at 1316, 1324 and 1332 Lake Drive should be based on the staff <br />report dated December 8, 2010, the findings of fact and conclusions of the staff report dated December 3, 2008, and <br />the following conditions of approval provided in the December 15, 2008 Planning and Zoning Commission approval <br />letter (Exhibit B): <br />1. The applicant shall undergo site plan review within one year for the subject property in accordance with <br />Chapter IV, Section XVIII "Site Plan Review" of the Casselberry Unified Land Development <br />Regulations, prior to commencement of development. No activity shall take place on the properties <br />prior to site plan approval and site construction permit issuance. <br />2. The applicant shall apply for a comprehensive plan amendment in order to change the future land use <br />designations from Low Density Residential (LDR) to Commercial on parcels 26A and 27 within one year <br />from the date of this approval. <br />3. This approval is for a maximum of 50 beds within the proposed Assisted Living Facility. This <br />development shall not be utilized for multi-family residential purposes. <br />4. The proposed Assisted Living Facility shall fully meet and comply with all applicable Certification and <br />Licensing requirements of the State of Florida including the Agency for Health Care Administration <br />(AHCA), Florida Statutes 408 and 429, and the Florida Administrative Code 56A-5. <br />5. The owner of the subject facility shall obtain a Business Tax Receipt from the City of Casselberry prior <br />to commencement of business operations. <br />6. No hazardous materials shall be used, stored or generated at the site. <br />
