After City Commission approval, the applicant shall provide the City with a check for the recording fees <br />(made payable to "Seminole County"), (1) mylar of the recorded plat executed by the owner, surveyor <br />and City Surveyor, and any other information requested as part of compliance to F.S. Chapter 177. <br />A brief discussion ensued regarding the outstanding comments from the City Attorney and Surveyor. Mr. <br />Parkhurst asked the applicant to come forward. Mr. John Przeclawski, 1860 State Road 436, Winter Park, Florida <br />came forward. The Commission had no questions for the applicant. <br />Mr, Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address SP 10-01. Mr. Aramendia made a motion to provide a <br />favorable recommendation from the Planning and Zoning Commission to the City Commission for SP 10-01 for the <br />Danubis Plaza preliminary replat as presented. Mr. Van Meter seconded the motion. The motion passed <br />unanimously by voice vote, <br />Fifth Item of Business: CU 10.09: Del Dios. Conditional use request to allow the consumption of alcoholic <br />beverages in conjunction with a restaurant operation in a CG zoning district. Property located at 5650 <br />Highway 17192, Casselberry, Florida. <br />Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated <br />December 1, 2010, supported by a PowerPoint presentation, to the City of Casselberry Planning and Zoning <br />Commission (a copy is on file in the Community Development Department). Mr. Sorensen said upon review of the <br />conditional use request, the Planning and Zoning Commission's approval for CU 10-09 to allow the on-site <br />consumption of alcoholic beverages as allowed by the 2COP state license, in conjunction with the operation of a <br />restaurant located at 5650 South US Highway 17-92, should be based on the findings of fact and conclusions of the <br />staff report dated December 1, 2010, and the following conditions: <br />1. The conditional use shall be limited to the location of 5650 South US Highway 17-92. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. The hours of alcohol sales shall comply with the hours set forth in Section 10-2 of the City of <br />Casselberry code. <br />5. Alcohol sales shall be ancillary to food sales. <br />6. The business shall remain incomplete compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services or vehicles. <br />8. The conditional use shall commence within 90 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />
